AMENDMENT NO.1 TO CONSTRUCTION CONTRACT
WITH GULF BUILDING CORP.
FOR ROBERTO CLEMENTE PARK RECREATION BUILDING, B -30172A
This Amendment No. 1 to the Contract dated April 6, 2009, (the "Contract")
between the City of Miami, a municipal corporation of the State of Florida ("CITY"), and
Gulf Building Corp., ("CONTRACTOR") for the project entitled "Roberto Clemente Park
Recreation Building, B -30172A", ("PROJECT"), for the construction of the Dorothy
Quintana Community Center, is entered into this day of
2010.
RECITALS
WHEREAS, the Contract was entered into pursuant to ITB. 08-09-020, issued
December 22, 2008, for the Scope of Work as stated in the original Contract Documents
for the PROJECT; and
WHEREAS, though the project was not originally contemplated to be Leadership in
Energy and Environmental Design ("LEED") certified, it was determined to be in the City's
best interest, as part of the Mayor's initiative to promote Green Building practices, to
pursue Leadership in Energy and Environmental Design ("LEED") Certification; and
WHEREAS, additional work was deemed necessary and performed for LEED
implementation in order to achieve a LEED Silver certification, in the not to exceed
amount of $125,562; and
WHEREAS, additional planned work is also to be performed, which includes the
furnishing and installation of new playground equipment and a new canopy structure, in
the not to exceed amount of $126,000 and an additional owner contingency in the not to
exceed amount of $15,877; and
WHEREAS, this Amendment No. 1 is now necessary, approved pursuant to R-
, to cover the additional work, in the amount of $267,439; and
WHEREAS, funds for the stated purpose are currently available from Project No.
B -30172A; and
NOW THEREFORE, for the considerations hereinafter set forth:
The Agreement dated April 6, 2009, is hereby amended as follows:
1. ADDITIONAL WORK is hereby revised to include all labor, materials and
equipment required to perform the additional work.
2. CONTRACT SUM is hereby increased by an amount not to exceed $267,439,
thereby increasing the total Contract Sum to Two Million Seventeen
Thousand, Four Hundred Thirty Nine Dollars ($2,017,439), thus increasing
the total award value, which includes a ten percent (10%) contract
contingency, to Two Million One Hundred Ninety Two Thousand, Four
Hundred Thirty Nine Dollars ($2,192,439).
All other terms and conditions of the Contract are in effect and remain unchanged.
