Purpose of Item: To retroactively authorize a change order for additional services, performed due to owner requested changes, design errors and omissions, and additional regulatory requirements, for the Fire Station No. 11 Improvements Project, B-60452, in the not to exceed amount of $4,796.64. Resolution further authorizes additional owner contingency in the not to exceed amount of $75,000, for resolution of outstanding issues. Resolution further authorizes the City Manager to execute Amendment No. 2 to the contract with NAC Construction, Inc., which increases the award value by $79,796.64, for a total award value not to exceed $3,854,196.64. Background Information: Pursuant to Resolution No. R-08-0501, enacted September 11, 2008, the City Commission accepted the bid of NAC Construction, Inc., as the lowest responsive bidder, and authorized execution of an Agreement for the "Fire Station No. 1 1 Improvements Project, B-60452," in the amount of $3,024,000 for the scope of work, plus an additional $302,400 owner contingency, for a total award amount of $3,326,400. On December 10, 2009, the City Commission adopted Resolution No. 09-0548, authorizing Amendment No. I which increased the award value by $448,000, from $3,326,400, to a total award' value of $3,774,400, for additional work due to unforeseen conditions. Additional work was deemed necessary and performed for Fire Station No. 11 due to owner requested changes, design errors and omissions, and additional regulatory requirements, in the amount of $4,796.64. Approval has also been requested for additional owner contingency in the not to exceed amount of $75,000, for resolution of outstanding issues. Continued... Director Chie QU City Manager Page 1 of 2 Construction Manager: Orlando Diez In the interest of maintaining continuity of work and to avoid undue additional costs, it was determined to be in the City's best interest to allow NAC Construction, Inc. to perform the additional work under their contract, which lacked sufficient award value to perform the work. This Amendment No. 2 increases the overall award amount by $79,796.64, for a total award value not to exceed $3,854,196.64.
