Bravo, P.E., Director �� Capital Improvements Program RECOMMENDATION DATE: September 7, 2010 FILE: SUBJECT: Waiver of Competitive Bidding Procedures: Approval of Amendment'No. 2 to NAC Construction, Inc. REFERENCES: Fire Station No. 11 Improvements Project, B-60452 ENCLOSURES: In the interest of maintaining continuity of work and to avoid undue additional costs, it was determined to be in the City's best interest to allow NAC Construction, Inc. to perform additional work deemed necessary and performed for the "Fire Station No. 11 Improvements Project, B- 60452," (Project) due to owner requested changes, design errors and omissions, and additional regulatory requirements, in the not to exceed amount of $4,796.64. We recommend that the City Commission concur to waive the formal requirements set forth in the Code of the City of Miami, as amended, in Section 18-85, and under Florida Statutes Section 255.0525 and 255.20, and affirm and adopt these findings, in order to increase the award value and retroactively authorize the additional work. Approval has also been requested for additional owner contingency, in the not to exceed amount of $75,000, for resolution of outstanding issues. This Amendment No. 2 would thus increase the award amount by $79,796.64, for a total not to exceed award amount of $3,854,196.64. BACKGROUND Pursuant to Resolution No. R-08-0501, enacted September 11, 2008, the City Commission accepted the bid of NAC Construction, Inc., as the lowest responsive bidder, and authorized execution of an Agreement for the "Fire Station No. 11 Improvements Project, B-60452," in the amount of $3,024,000 for the scope of work, plus an additional $302,400 owner contingency, for a total award amount of $3,326,400. On December 10, 2009, the City Commission adopted Resolution No. 09-0548, authorizing Amendment No. 1, which increased the award value by $448,000, from $3,326,400, to a total award value of $3,774,400, for additional work due to the unforeseen conditions. Your signature below will signify your concurrence with the above recommendation and your assimilation of these findings as your own justification for the waiver of competitive bidding procedures and recomme dation to authorize execution of Amendment No. 2 to the contract with NAC Construction, Inc. fo the additional work.
