Please make arrangements to publish the attached Notice of Public Hearing regarding the
ratification, approval, and confirmation of the City Manager's Findings to waive competitive
bidding procedures, approving a final change order to Giannetti Contracting Corp., for additional
services performed due to unforeseen conditions and owner requested changes, such as utility
conflicts, additional signage, Royal Palm relocations, relocation of encased electrical cables,
and installation of a conflict manhole and other elements, for the North Bayshore Drive
Drainage Improvements Project, B-50658. Approval has also been requested for additional
planned work, which includes CRA requested skate board deterrents on the bulkhead walls at
Margaret Pace Park.
A 14 day notice is sufficient and we would like the item to be heard on September 23, 2010.

FINDINGS FOR WAIVER OF BIDDING PROCEDURES TO APPROVE THE
FINAL CHANGE ORDER FOR ADDITIONAL WORK FOR THE NORTH
BAYSHORE DRIVE DRAINAGE IMPROVEMENTS PROJECT, B-50658.

The Miami City Commission will hold a Public Hearing on September 23, 2010 beginning at 9:00 a.m. to
consider whether it is in the public's best interest that the City Commission ratify, approve and confirm
the Findings of the City Manager justifying the waiver of competitive bids to approve payment in the
amount of $326,401, for a final change order to Giannetti Contracting Corporation for additional work
performed due to unforeseen conditions and owner requested changes, such as utility conflicts, pay -item
errors, Royal Palm relocations, relocation of encased electrical cables, and installation of a conflict
manhole, and for additional planned work including skateboard deterrents on the bulkhead walls at
Margaret Pace Park, and stamped asphalt as decorative crosswalks at the two intersections of North
Bayshore Drive, for the North Bayshore Drive Drainage Improvements Project, B-50658.
The Public Hearing will be held in conjunction with the regularly scheduled City Commission meeting of
September 23, 2010 at:

All interested persons may appear at the meeting and may be heard with respect to the proposed issue.
Should any person desire to appeal any decision of the City Commission with respect to any matter to be
considered at this meeting, that person shall ensure that a verbatim record of the proceedings is made
including all testimony and evidence upon which any appeal may be based (F.S. 286.0105).
In accordance with the Americans with Disabilities Act of 1990, persons needing special accommodations
