HomeMy WebLinkAboutLegislationb City of Miami City Hall 3500 Pan American Drive Legislation Miami, FL 33133 crJ. i www.miamigov.com w Resolution File Number: 10-01018 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), RETROACTIVELY AUTHORIZING A CHANGE ORDER FOR ADDITIONAL SERVICES PERFORMED DUE TO UNFORESEEN CONDITIONS AND OWNER REQUESTED CHANGES, SUCH AS UTILITY CONFLICTS, ADDITIONAL SIGNAGE, ROYAL PALM RELOCATIONS, RELOCATION OF ENCASED ELECTRICAL CABLES, AND INSTALLATION OF A CONFLICT MANHOLE AND OTHER ELEMENTS, FOR THE NORTH BAYSHORE DRIVE DRAINAGE IMPROVEMENTS PROJECT, B-50658, IN THE NOT TO EXCEED AMOUNT OF $220,182; RESOLUTION FURTHER AUTHORIZES THE PERFORMANCE OF ADDITIONAL OWNER -REQUESTED FUTURE WORK WHICH HAS BEEN PLANNED, AS PART OF THE CHANGE ORDER, INCLUDING SKATE BOARD DETERRENTS ON THE BULKHEAD WALLS, IN THE NOT TO EXCEED AMOUNT OF $5,454; RESOLUTION FURTHER AUTHORIZES THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE CONTRACT WITH GIANNETTI CONTRACTING CORP. ("GIANNETTI"), WHICH INCREASES THE AWARD VALUE BY $225,636, FOR A TOTAL AWARD VALUE NOT TO EXCEED $1,609,365.24. WHEREAS, fourteen (14) bids were received by the Office of the City Clerk on February 13, 2009, pursuant to formal Invitation for Bids No. 08-09-025, issued on December 29, 2008, for the project entitled "North Bayshore Drive Drainage Improvements, B-50658" (Project); and WHEREAS, the City Manager authorized execution of an Agreement with Giannetti, the lowest responsive and responsible bidder, in the total amount of $1,257,935.68, plus an owner contingency of $125,793.56, for a total not to exceed amount of $1,383,729.24, awarded under the expedited list of projects pursuant to Expedite Ordinance No. 13045; and WHEREAS, additional work was deemed necessary and performed for North Bayshore due to unforeseen conditions and owner requested changes, such as utility conflicts, additional signage, Royal Palm relocations, relocation of encased electrical cables, and installation of a conflict manhole and other elements, in the amount of $220,182; and WHEREAS, in the interest of maintaining continuity of work and to avoid undue additional costs, it was determined to be in the City's best interest to allow Giannetti to perform the additional work under their contract, which lacked sufficient award value to perform the work; and WHEREAS, approval has also been requested for additional planned work, which includes CRA requested skate board deterrents on the bulkhead walls at Margaret Pace Park, at a cost of $5,454; and WHEREAS, this Amendment No. 1 increases the overall award amount by $225,636, for a total not City of Miami Page 1 of 2 File Id: 10-01018 (Version: 1) Printed On: 9/14/2010 File Number: 10-01018 to exceed award amount of $1,609,365.24; and WHEREAS funds are available from Capital Improvement Project No. B-50658; and WHEREAS, the new award value ensures payment for the additional work performed and the additional planned work necessary to complete the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1 } to execute Amendment No. 1 to the Construction Contract with Giannetti Contracting Corp., in substantially the attached form, increasing the award value by a not to exceed amount of $225,636, for the North Bayshore Drive Drainage Improvements, B-50658, with funds allocated from Capital Improvement Project No. B-50658. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
