Migoya DATE: September 3, 2010 FILE: City Manager SUBJECT: Waiver of Competitive Bidding Procedures: Approval of Amendment No. 1 to Giannetti Contracting Corp. FROM: Alice N. Bravo, P.E., Director REFERENCES: North Bayshore Drive Capital Improvements Program Drainage Improvements Project, B-50658 ENCLOSURES: RECOMMENDATION In the interest of maintaining continuity of work and to avoid undue additional costs, it was determined to be in the City's best interest to allow Giannetti Contracting Corp. (Giannetti) to perform additional work deemed necessary and performed for the "North Bayshore Drive Drainage Improvements Project, B-50658" (Project) due to unforeseen conditions and owner requested changes, such as utility conflicts, additional signage, Royal Palm relocations, relocation of encased electrical cables, and installation of a conflict manhole and other elements, in the not to exceed amount of $220,182. We recommend that the City Commission concur to waive the formal requirements set forth in the Code of the City of Miami, as amended, in Section 18-85, and under Florida Statutes Section 255.0525 and 255.20, and affirm and adopt these findings, in order to increase the award value and retroactively authorize the additional work. Approval has also been requested for additional planned work, which does not require a waiver of competitive bidding procedures, which includes CRA requested skate board deterrents on the bulkhead walls at Margaret Pace Park, in the not to exceed amount of $5,454. This Amendment No. 1 would thus increase the award amount by $225,636, for a total not to exceed award amount of $1,609,365.24. BACKGROUND Fourteen (14) bids were received by the Office of the City Clerk on February 13, 2009, pursuant to formal Invitation for Bids No. 08-09-025, issued on December 29, 2008, for the Project. The City Manager authorized execution of an Agreement with Giannetti, the lowest responsive and responsible bidder, in the total amount of $1, 257,935.68, plus an owner contingency of $125,793.56, for a total not to exceed amount of $1,383,729.24, awarded under the expedited list of projects pursuant to Expedite Ordinance No. 13045. Your signature below will signify your concurrence with the above recommendation and your assimilation of these findings as your own justification for the waiver of competitive bidding procedures and recommendation to authorize execution of Amendment No. 1 to the contract with.
