HomeMy WebLinkAboutLegislationCity of Miami rMI.., "" a % Legislation Resolution File Number: 10-01044 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A TOTAL NOT TO EXCEED AMOUNT OF $465,962 IN THE FORM OF ONE (1) REIMBURSEMENT GRANT ("GRANT AWARD") FROM THE CHILDREN'S TRUST TO THE CITY'S DEPARTMENT OF PARKS AND RECREATION ("DEPARTMENT") FOR THE HEART OF OUR PARKS SCHOOL YEAR OUT OF SCHOOL PROGRAM ("HEART OF OUR PARKS PROGRAM"), ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "THE CHILDREN'S TRUST GRANT FOR PARKS 2010-2011," TO FUND THE DEPARTMENT'S HEART OF OUR PARKS PROGRAM AT JUAN PABLO DUARTE PARK, SHENANDOAH PARK, JOSE MARTI PARK, WEST END PARK, AND AFRICAN SQUARE PARK, AND AUTHORIZING IN-KIND SERVICES FROM THE CITY VALUED AT NOT TO EXCEED $188,983.60 ("IN-KIND SERVICES"); FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE CHILDREN'S TRUST, IN SUBSTANTIALLY THE ATTACHED FORM ("THE CHILDREN'S TRUST CONTRACT") AND TO EXECUTE ALL OTHER NECESSARY DOCUMENTS, AFTER CONSULTATION WITH THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE GRANT AWARD FOR SAID PURPOSES, THUS AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE PROFESSIONAL SERVICES AGREEMENTS IN COMPLIANCE WITH THE ATTACHED FORM OF THE CHILDREN'S TRUST CONTRACT, FOR THE PERIOD COMMENCING AUGUST 1, 2010 THROUGH JULY 31, 2011, WITH THE OPTIONS TO RENEW FOR UP TO TWO (2) ADDITIONAL SIMILAR PERIODS AT THE SAME TERMS AND CONDITIONS; AUTHORIZING THE APPROPRIATION OF THE GRANT AWARD AND THE IN-KIND SERVICES FOR THE HEART OF OUR PARKS PROGRAM FOR THE INITIAL FISCAL YEAR 2010-2011, WITH FUTURE FISCAL YEARS' FUNDING AND IN-KIND SERVICES SUBJECT ONLY TO BUDGETARY APPROVAL. WHEREAS, the City of Miami's Department of Parks and Recreation ("Department") has been awarded one (1) reimbursement grant from The Children's Trust for Out of School Programs in the total not to exceed amount of $465,962.00 for the Heart of Our Parks School Year Out of School Program ("Heart of Our Parks Program") commencing as of August 1, 2010 through July 31, 2011, and the City of Miami ("City") and The Children's Trust have negotiated and The Children's Trust has provided the form of contract, in substantially the attached form ("The Children's Trust Contract") for said purposes; and WHEREAS, the Heart of Our Parks Program is comprised of a cooperative effort between the Department and three (3) not-for-profit organizations: Amigos Together For Kids, Inc., d/b/a Amigos for Kids, Arts for Learning/Miami, Inc., and the Miami -Dade Family Learning Partnership, Inc. (collectively, the "Service Providers"); and City of Miami Page I of 3 File Id. 10-01044 (Version: 1) Printed. On: 9/10/2010 File Number 10-01044 WHEREAS, the goal of the Heart of Our Parks Program is to improve the overall health, well-being and academic achievement of children and the decrease of their involvement in behaviors that may put them at risk; and WHEREAS, previously pursuant to Resolution No. 07-00632, adopted on November 9, 2007, and Resolution No. 08-00957, adopted on September 11, 2008, the City of Miami Commission authorized the execution of award packages for the Heart of Our Parks Program, including the grant award agreements, to accept the grants; and WHEREAS, the City of Miami has now been awarded one (1) additional grant in the not to exceed amount of $465,962.00 ("Grant Award") from The Children's Trust for the Heart of Our Parks Program to continue services and the City is providing in-kind services valued at the not to exceed amount of $188,983.60 ("In -Kind Services"); and WHEREAS, the City of Miami must execute one (1) award package including the new form of The Children's Trust Contract, to accept the grant in order to enter into similar professional service agreements with the Service Providers in order to comply with The Children's Trust's requirements; and WHEREAS, the City Manager and the Department by separate Resolution are also today requesting for the City Commission to authorize the City Manager to negotiate and execute Professional Service Agreements ("Agreements") in compliance with the attached form of The Children's Trust Contract, with the Service Providers for the period of August 1, 2010 through June 11, 2011 with the options to extend or renew for up to two (2) additional similar periods for the same terms and conditions; and WHEREAS, the City Manager and the Department are requesting the appropriation of said Grant Award and In -Kind Services for the Heart of Our Parks Program and for the related Agreements with the Service Providers for the initial Fiscal Year 2010-2011, with future Fiscal Years' funding and in-kind services subject only to budgetary approval; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference incorporated as if fully set forth in this section. Section 2. The City Manager is authorized{1} to accept a total not to exceed amount of $465,962 in the form of one (1) reimbursement grant ("Grant Award") from The Children's Trust to the City's Department of Parks and Recreation ("Department") for the Heart of Our Parks School Year Out of School Program ("Heart of Our Parks Program") at Juan Pablo Duarte Park, Shenandoah Park, Jose Marti Park, West End Park, and African Square Park and to provide in-kind services from the City valued at the not to exceed amount of $188,983.60. Section 3. The City Manager is further authorized(l) to execute an agreement with The Children's Trust, in substantially the attached form, ("The Children's Trust Contract") and to execute all other necessary documents, after consultation with the City Attorney, to implement the acceptance of and compliance with the Grant Award for said purposes, thus authorizing the City Manager to execute professional services agreements in compliance with the attached Children's Trust Contract, for the period commencing August 1, 2010 through July 31, 2011, with options to renew for up to two (2) additional similar periods at the same terms and conditions. Section 5. The Grant Award and the In -Kind Services are allocated for the Heart of Our Parks Program for the initial Fiscal Year 2010-2011, with future fiscal years' funding and in-kind services subject only to budgetary approval. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2) APPROVED AS TO FORM AND CORRECTNESS JULIE O. BRU p (� CITY ATTORNEY Footnotes: (1) The herein authorization is further subjected to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2) if the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
