HomeMy WebLinkAboutR-10-0397Vop City of Miami F .. , * Legislation i 0 R �O Resolution: R-10-0397 File Number: 10-01059 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/16/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE CITY OF CORAL GABLES, IN SUBSTANTIALLY THE ATTACHED FORM, FOR A PERIOD OF THREE (3) YEARS, WITH TWO (2) OPTIONS TO RENEW ON AYEAR-BY-YEAR BASIS, FOR USE OF THE MIAMI VIRGINIA KEY COMPOST/MULCH FACILITY FOR ITS DISPOSAL OF CLEAN YARD TRASH AT AN AGREED-UPON DISPOSAL FEE RATE. WHEREAS, the City of Miami and the City of Coral Gables find and declare that it is necessary to the health, safety and welfare of the citizens of Miami and Coral Gables to provide for the disposal of clean yard trash; and WHEREAS, the City of Miami desires to maximize the use of its Virginia Key Compost/Mulch Facility; and WHEREAS, the City of Coral Gables desires to use the Miami Virginia Key Compost/Mulch Facility for yard trash disposal at an agreed-upon disposal fee rate; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute an Agreement with the City of Coral Gables, in substantially the attached form, for a period of three (3) years, with two (2) options to renew on a year -by -year basis, for the use of the Miami Virginia Key Compost/Mulch Facility for its disposal of clean yard trash at an agreed-upon disposal fee rate. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: City of Miand Page 1 of 2 File Id. 10-01059 (Version: 2) Printed On: 8/8/2017 File Number: 10-01059 Enactment Number: R-10-0397 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
