HomeMy WebLinkAboutLEGISLATIONFile ;1Tumber: 10-01039 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE CITY OF NORTH MIAMI, IN. SUBSTANTIALLY THE ATTACHED FORM, FOR A PERIOD OF THREE (3) YEARS, WITH TWO (2) OPTIONS TO RENEW ON A YEAR -BY -YEAR BASIS, FOR USE OF THE MIAMI VIRGINIA KEY COMPOST/MULCH FACILITY FOR ITS DISPOSAL OF CLEAN YARD TRASH AT AN AGREED-UPON DISPOSAL FEE RATE. WHEREAS, the City of Miami and the City of North Miami find and declare that it is necessary to the health, safety and welfare of the citizens of Miami and North Miami to provide for the disposal of clean yard trash; and WHEREAS, the City of Miami desires to maximize the use of its Virginia Key Compost/Mulch Facility; and WHEREAS, the City of North Miami desires to use the Miami Virginia Key Compost/Mulch Facility for yard trash disposal at an agreed-upon disposal fee rate; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized {1) to execute an Agreement with the City of North Miami, in substantially the attached form, for a period of three (3) years, with two (2) options to renew on a year -by -year basis, for the use of the Miami Virginia Key Compost/Mulch Facility for its disposal of-clean--yard=tr-ash=at=an=agreed-upon-disposal=fee=r-ate. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: JULIE 0. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
