HomeMy WebLinkAboutLegislationResolution File Number: 10-01036 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), RATIFYING THE MEMORANDUM OF UNDERSTANDING, AMENDING ARTICLE 52.1 (PENSION), OF THE COLLECTIVE BARGAINING AGREEMENT, BETWEEN THE CITY OF MIAMI AND THE MIAMI GENERAL EMPLOYEES, AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, LOCAL 1907 (AFSCME), IN EFFECT FOR THE PERIOD OF OCTOBER 1, 2007 THROUGH SEPTEMBER 30, 2010, SUBJECT TO THE CONDITIONS IMPOSED BY FLORIDA STATUTE 447:309(1). BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Memorandum of Understanding, amending Article 52.1(Pension), of the Collective Bargaining Agreement, between the City of Miami and the Miami General Employees, American Federation of State, County, and Municipal Employees, Local 1907 (AFSCME), in effect for the period of October 1, 2007 through September 30, 2010, is ratified, subject to the conditions imposed by Florida Statute 447.309(1). Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS:tµi JULIE O. BR CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. City of Miami Page I of I File Id. 10-01036 (Version: 1) Printed On: 812612010 MEMORANDUM OF UNDERSTANDING City of Miami & AFSCME, Local 1907 +L-1 This Memorandum of Understanding is entered into this ZO day of -�J�� -t, 2010 between the City of Miami ("City") and the Miami General Employees, American Federation of State, County, and Municipal Employees, Local 1907 ("AFSCME") (jointly "the Parties") to modify the 2007-2010 Collective Bargaining agreement ("CBA") as follows: WHEREAS, the Parties have met and mutually agree to modify Article 52.1 of the existing CBA as it relates to retirement eligibility; and NOW THEREFORE, the Parties agree: 1. For a thirty (30) calendar day period, any general employee who has attained a combination of age plus years of creditable service equal to sixty four (64) shall be eligible to retire, provided the member has completed not less than ten (10) years of creditable service, and provided the conditions in § 2 and _§ 3 herein are met. 2. General employees eligible to retire pursuant to § 1 may not participate in the Deferred Retirement Option Plan (DROP)' and shall separate from City service no later than September 30, 2010. 3. The thirty day period referred to in § 1 shall commence upon ratification by the airy Commission. NOW THEREFORE, this MOU shall become effective upon ratification by the Parties.
