HomeMy WebLinkAboutCC Legislation (Version 2)A �F� } 4>j City of Miami �\tea ,�Kax� YOA,f f Legislation Ordinance File Number: 10-00185zc City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, THE MIAMI 21 CODE, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY CHANGING THE FOLLOWING ZONING CLASSIFICATIONS FROM "C/I - CIVIC/[ NSTITUTION ZONE" TO 76-8 O - URBAN CORE TRANSECT ZONE" FOR THE PROPERTY LOCATED AT 1600 NORTHWEST 3RD AVENUE, MIAMI, FLORIDA; BY CHANGING THE ZONING CLASSIFICATION FROM 75-0 - URBAN CENTER TRANSECT ZONE" TO 74-0 - GENERAL URBAN TRANSECT ZONE" FOR THE PROPERTIES LOCATED ALONG SOUTHWEST 27TH AVENUE, GENERALLY BOUND BY SOUTHWEST 22ND TERRACE TO THE NORTH AND U.S.1 TO THE SOUTH, MIAMI, FLORIDA; BY CHANGING THE ZONING CLASSIFICATION FROM 75-0 - URBAN CENTER TRANSECT ZONE" TO 74-0 - GENERAL URBAN TRANSECT ZONE" FOR THE PROPERTIES LOCATED ALONG THE EAST SIDE OF SOUTHWEST 32ND AVENUE, FROM SOUTHWEST 16TH STREET TO THE NORTH PORTION OF THE BLOCK FRONTING SOUTHWEST 32ND AVENUE AND 18TH STREET, MIAMI, FLORIDA; AND BY CHANGING THE ZONING CLASSIFICATION FROM 76-8 O - URBAN CORE TRANSECT ZONE" TO 75-0 - URBAN CENTER TRANSECT ZONE" FOR THE PROPERTIES ALONG SOUTHWEST 22ND STREET (CORAL WAY), GENERALLY BOUND BY SOUTHWEST 17TH AVENUE TO THE EAST AND SOUTHWEST 37TH AVENUE TO THE WEST, MIAMI, FLORIDA; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE OF MAY 20, 2010. WHEREAS, on October 22, 2009, the City Commission adopted the Miami 21 Code ("Code"), Ordinance No. 13114; and WHEREAS, on January 28, 2010, the City Commission extended the implementation date to May 20, 2010, Ordinance No. 13138; and WHEREAS, the Miami Planning Advisory Board, at its meeting on March 3, 2010, Item No. P.2, following an advertised public hearing, adopted Resolution Nos. PAB-10-003(a), PAB-10-003(b), PAB-10-003(c), and PAB-10-003(d), by a vote of eight to zero (8-0), recommending APPROVAL of change of zoning classification as hereinafter set forth; and WHEREAS, amendments are being made prior to its implementation date to address certain property issues; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to approve this change of zoning classification as hereinafter set forth; City of Miami Page 1 of 3 File Id: 10-00185zc (Version: 2) Printed On: 3/4/2010 File Number.' 10-00185zc NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The zoning Atlas of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended, is further amended by changing the following zoning classifications from "C/I Civic/Institution Zone" to 76-8 O - Urban Core Transect Zone" for the property located at 1600 Northwest 3rd avenue; by changing the zoning classification from 75-0 - Urban Center Transect Zone" to 74-0 - General Urban Transect Zone" for the properties located along Southwest 27th Avenue, generally bound by Southwest 22nd Terrace to the north and U.S.1 to the south, Miami, Florida; by changing the zoning classification from 75-0 - Urban Center Transect Zone" to 74-0 - General Urban Transect Zone" for the properties located along the east side of Southwest 32nd Avenue, from Southwest 16 Street to the north portion of the block fronting Southwest 32nd Avenue and 18th Street, Miami, Florida; by changing the zoning classification from 76-8- O -Urban Core Transect Zone" to 75-0 - Urban Center Transect Zone" for the properties along Southwest 22nd Street (Coral Way), generally bound by Southwest 17th Avenue to the east and Southwest 37th Avenue to the west, Miami, Florida. Section 3. The Zoning Atlas, made a part of Ordinance No. 13114, the Miami 21 Code, as amended, the Zoning Ordinance of the City of Miami, Florida, as amended, by reference and description in said Ordinance, is amended to reflect the changes made necessary by this Amendment. Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Code of the City of Miami, Florida, as amended which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 6. These amendments to the Miami 21 Atlas shall be implemented May 20, 2010. {2} APPROVED AS TO FORM AND CORRECTNESSt/ V 5 JULIE O. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
