A RESOLUTION OF THE MIAMI CITY COMMISSION GRANTING AN EXTENSION
OF THE DURATION OF A SINGLE EVENT BY CLASS I SPECIAL PERMIT
(BEYOND THE TWO (2) WEEKS ALLOWED PER EVENT), FOR THE PLACEMENT
OF A SERIES OF PEACOCK SCULPTURES KNOWN AS THE PEACOCK TOUR IN
COCONUT GROVE, PURSUANT TO RESOLUTION NO. 10-0109, ADOPTED
MARCH 11, 2010, FROM AUGUST, 2010 TO FEBRUARY, 2011; WITH SAID CLASS
I SPECIAL PERMIT SUBJECT TO REVIEW AND APPROVAL BY THE ZONING
ADMINISTRATOR AS SET FORTH IN ARTICLES 13 AND 14 OF THE ZONING
CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; AUTHORIZING THE
CITY MANAGER TO WAIVE ALL CLASS I SPECIAL PERMIT FEES FOR SUCH
EVENT.
WHEREAS, the applicable provisions of Section 906.9 of the Zoning Ordinance of the City of
Miami, Florida, as amended ("Zoning Code"), provide, in part, that (unless approved by a four-fifths
(4/5ths) affirmative vote of the City Commission waiving this requirement) no individual event shall
have a duration of more than two (2) weeks, unless authorized for such by the City Commission; and
WHEREAS, pursuant to Resolution No. 10-0109, adopted March 11, 2010, the City Commission
authorized said waiver through August, 2010; and
WHEREAS, members in the community have expressed an interest in extending the Peacock
Tour;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The extension of the duration of a single event by Class I Special Permit (beyond the
two (2) weeks allowed per event), for the placement of a series of peacock sculptures known as the
Peacock Tour in Coconut Grove, pursuant to Resolution No. 10-0109, adopted March 11, 2010, is
granted from August, 2010 to February, 2011, with said Class I Special Permit subject to review and
approval by the Zoning Administrator as set forth in Articles 13 and 14 of the Zoning Code.
Section 3. The City Manager is authorized{1 } to waive all Class I Special Permit fees for such
event.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
