HomeMy WebLinkAboutLegislationFile Number: 10-00853 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY TRANSIT ("COUNTY"), IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE MIAMI RIVER GREENWAY SOUTHWEST 1 ST COURT PROJECT, B-30130 ("PROJECT"); FURTHER GRANTING AND CONVEYING TO THE CITY OF MIAMI A NON-EXCLUSIVE PERMIT TO ENTER AND REMAIN ON THE COUNTY'S PROPERTY FOR THE PURPOSE OF PERFORMING THE SCOPE OF WORK, AND PROVIDING THAT THE COUNTY MAINTAIN THE PROJECT. WHEREAS, the City of Miami ("City") and Miami -Dade County Transit ("County") wish to provide bicycle/pedestrian path and sidewalk enhancements located within the municipal limits of the City; and WHEREAS, the scope of the project consists of upgrading the existing 8 -foot asphalt sidewalk to a 10 -foot decorative concrete path beginning from the corner of Southwest 1 st Court and Southwest 7th Street, Miami, Florida, matching the existing sidewalk and continuing along the Metrorail/Metromover corridor ("Project"); and WHEREAS, the Project also encompasses the addition of a new 5 -foot sidewalk on the east side of Southwest 1st Court, Miami, Florida; and WHEREAS, the City will be responsible for the design, construction, management and administration of the Project, which is partially funded by a grant from the Florida Department of Transportation; and WHEREAS, the attached Interlocal Agreement ("Agreement') provides that the County agrees to maintain the Project, and will provide the City access for the completion of the scope of work subject to the conditions of the Agreement; and WHEREAS, said Agreement results in no fiscal impact to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute an Agreement with the County, in substantially the attached form, for the Project, granting and conveying to the City a non-exclusive permit to enter and remain on the County's property for the purpose of performing the scope of work, and providing that the County maintain the Project. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: JULIE B RIJ- CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
