Division Law Department Commission Meeting Date: 7/22/2010 District Impacted: 1 Matter ID No. 10-1451 Type: ® Resolution ❑ Ordinance ❑ Emergency Ordinance ❑ Discussion Item ❑ Other Subject: Revocable License Agreement (RLA) between the City of Miami and Miami Bridge Youth and Family Services, Inc. , a non-profit for the use of 2916, 2810 & 2910 NW South River Drive, Miami Purpose of Item: A Resolution of the Miami City Commission, authorizing the City Manager to execute a Revocable License Agreement ("Agreement"), in substantially the attached form, between the City of Miami and Miami Bridge Youth and Family Services, Inc. a non-profit corporation ("Licensee"), for the use of property located at 2810, 2910 & 2916 NVQ South River Drive, Miami, Florida (collectively the "Property"); commencing on the Effective Date ("Effective Date'), for use as a 24/7 emergency residential shelter for runaways and for crisis counseling, for an initial term of seven (7) years, with the option to renew for two (2) additional five-year terms and providing for a monthly use fee ("Monthly Use Fee") of Five Hundred'Dollars ($500.00), as adjusted by five percent (5%) every subsequent five year term, further providing for Licensee's payment of any armual state fees for state- owned parcels; and providing for the termination of the existing Revocable Permit upon execution of this Agreement; authorizing the City Manager to make non -substantive amendments to such Agreement as needed; with terms and conditions more particularly set forth in the Agreement, subject to City Attorney approval. Director Chief City Manager_ Page 1 of 2 c �V,,0 Subject: Revocable License Affeement (RLA) between the City of Miami and Miami Bridge Youth and Family Services, Inc. , a non-profit for the use of 2916, 2810 & 2910 NW South River Drive. Miami Background Information: Miami Bridge Youth and Family Services, Inc,, a non-profit corporation ("Licensee") entered into a Revocable Pen -nit Agreement with the City of Miami for the use of several upland parcels, one of which is the city -owned property located at (2916 NW South River Drive, Miami, FL.) and two of Which are state-owned upland parcels located at 2810 and 2910 NW South River Drive, Miami, FL., (collectively, the "Property"). This non-profit corporation provides 2417 emergency residential shelter services for young runaways and the Licensee now seeks to continue this use at the subject Property. At the inception of the original Revocable Permit Agreement, the City obtained a long-term, state lease (State Lease No. 3678) expiring in January 2039 to allow for the non -profit's above-described uses. While the underlying state lease is still current and the Licensee is not changing its use of the Property, the City needs to obtain approval from the state to approve the continued use of the state- owned parcels. The Licensee will pay a security deposit of Five Hundred Dollars ($500.00.). Upon the City Commission's approval of the city's new Revocable License Agreement with the Licensee, the city will seek formal approval from the state for the Licensee's continued use of the Property. Once the city has obtained state approval, it will execute the attached Agreement and terminate the existing Revocable Permit. Page 2 of 2
