A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE FUNDING
OF NINE (9) MONTHS OF LEASE PAYMENTS, ON A MONTH-TO-MONTH BASIS,
PER PROVISIONS CONTAINED UNDER PARAGRAPH 10 OF THE EXPIRED
LEASE AGREEMENT WITH GROVITES UNITED TO SURVIVE, FOR THE USE OF
APPROXIMATELY 3,197 SQUARE FEET OF SPACE ($6.74 PER SQUARE FOOT),
OF THE PROPERTY LOCATED AT 3686 GRAND AVENUE, MIAMI, FLORIDA,
BEING USED AS A RECREATIONAL FACILITY FOR THE MIAMI POLICE ATHLETIC
LEAGUE, A CRIME PREVENTION PROGRAM, IN A TOTAL AMOUNT NOT TO
EXCEED $16,163.37; ALLOCATING FUNDS FROM THE LAW ENFORCEMENT
TRUST FUND, AWARD NO. 1169, PROJECT NO. 19-690001 AND ACCOUNT
CODE 12500.191602.544000.0000.00000, WITH SUCH EXPENDITURES HAVING
BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH SECTION
932.7055, FLORIDA STATUTES, AS AMENDED.
WHEREAS, pursuant to Resolution No. 07-0288, adopted May 24, 2007, the City Commission
authorized the City Manager to enter into a Lease (the "Lease"), effective October 1, 2006, with
Grovites United to Survive, Inc. (the "Lessor"), owners of property located at 3686 Grand Avenue,
Miami Florida, for the use of approximately 3,197 square feet of space (the "Premises"), at an initial
monthly rate of $6.20 per square foot, to operate as a recreational facility for the Miami Police Athletic
League Program; and
WHEREAS, the Lease expired on September 30, 2009, and the City of Miami ("City") does not
wish to pursue a new Lease with the Lessor; and
WHEREAS, the City is obligated to fund nine (9) months (October 1, 2009 to June 30, 2010),
of lease payments, on a month-to-month basis as per provisions under Paragraph 10 of the expired
Lease Agreement; and
WHEREAS, funding for the Lease of this property was not included in the City Department of
Police's normal operating budget and is available in the City's Law Enforcement Trust Fund; and
WHEREAS, the Chief of Police has recommended adoption of this Resolution and has
determined that the expenditures proposed comply with the Section 932.7055, Florida Statutes, as
amended; and
WHEREAS, the City will vacate the premises and remove all personal property, trade fixtures
and any other property from the building by Wednesday, June 30, 2010;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission authorizes the funding of nine (9) months of Lease
payments, on a month-to-month basis, per provisions contained under Paragraph 10 of the expired
Lease Agreement with the Lessor, for the use of the Premises, being used as a recreational facility
for the Miami Police Athletic League, a crime prevention program, in a total amount not to exceed
$16,163.37, with funds allocated from the Law Enforcement Trust Fund, Award No. 1169, Project No.
19-690001 and Account Code 12500.191602.544000.0000.00000, with such expenditures having
been approved by the Chief of Police as complying with Section 932.7055, Florida Statutes, as
amended.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor. {1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
