Thompson References: July 8, 2010 Agenda City Clerk Enclosures: List of members The Virginia Key Beach Park Trust was created to preserve the Virginia Key Beach Park in cooperation with the Department of Parks and Recreation and other City departments in a manner consistent with the environmental health, public use, historical importance of the Park and the aspirations of the African American community and shall propose policy, planning, and design to ensure maximum community utilization, enjoyment, and maintenance of the Park as an open green space compatible with its historical and recreational characteristics and accessible to the public. Ordinance 13065, adopted on May 14, 2009, which amended Chapter 38, Article 6 of the City Code, authorized the waiver of the eight -consecutive year term limitation to allow members of the Virginia Key Beach Park Trust to be reconsidered annually for an additional one-year term by a unanimous vote of the members of the City Commission. While appointments were made at the March 11, 2010 meeting, two (2) corrections are needed.z • The Commission -at -Large has one (1) nomination to be made from the recommendation proffered by the trust. 1. The appointment of Belle Gray as an at -large member to the board was not made in accordance with Sec. 38-233(a);(3). The three (3) at -large members are nominated by a majority of the existing trust members and confirmed and appointed by the City Commission. Ms. Belle Gray's name was not proffered by the trust and therefore, one (1) at - large vacancy remains to be filled. • The at -large reappointment of Ms. Enid Pinkney to the trust was approved by the Commission, along with a 5/5 term limit waiver. We were advised that Ms. Pinkney will also require a 4/5 residency waiver as she no longer owns property in the city. For your convenience, we are including a copy of the membership of the Trust. By copy of this memorandum, we are requesting the Agenda Office to place this issue on the July 8, 2010 Commission agenda.
