HomeMy WebLinkAboutLegislationcit` OF yq,• City of Miami City Hall 3500 Pan American Oil jRCt',fbTS ;4:;: ya '� Legislation Drive Miami, FL 33133 www.miamigov.com Resolution File Number: 10-00756 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE MIAMI BETHANY COMMUNITY SERVICES, INC., TO AMEND THE SCOPE OF WORK AND EXTEND THE TERMS OF THE CONTRACT FROM SEPTEMBER 30, 2008 TO SEPTEMBER 30, 2011, PURSUANT TO RESOLUTION NO. 08-0695, ADOPTED DECEMBER 13, 2007, FOR THE UPGRADE OF THE PLAYGROUND AREA CURRENTLY BEING USED BY THE CHILDCARE AND AFTER SCHOOL PROGRAM. WHEREAS, Miami Bethany Community Services, Inc. ("Miami Bethany"), located at 2490 Northwest 35th Street, Miami, Florida, is an agency dedicated to the holistic, physical, emotional and spiritual empowerment of the underserved communities of Greater Miami and the Allapattah area; and WHEREAS, pursuant to Resolution No. 05-0477, adopted July 28, 2005, the Miami City Commission approved the allocation of $60,000 to Miami Bethany for public facilities and improvements to build a commercial kitchen for the after school program serving low to moderate income children in the Allapattah area; and WHEREAS, pursuant to Resolution No. 06-0649, adopted November 9, 2006, the Miami City Commission approved the extension of the contract for said project to September 30, 2007; and WHEREAS, pursuant to Resolution No. 07-0695, adopted December 13, 2007, the Miami City Commission approved the extension of said contract to September 30, 2008 and the rollover of the funds; and WHEREAS, Miami Bethany was unable to complete the project by the contract date, due to increasing construction costs resulting from bringing the whole facility up to code; and WHEREAS, on March 20, 2010, Miami Bethany requested permission to utilize the funding for the installation and upgrade of the playground facility currently being used by the children attending the childcare and after school program; and WHEREAS, the Administration recommends amending the scope of work for said project and to extend the term of the contract to September 30, 2011, to allow Miami Bethany to install and upgrade the playground facility being used by the after school program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2. The City Manager is authorized {1} to execute an Agreement, in substantially the attached form, with Miami Bethany, to amend the scope of work and extend the terms of the contract from September 30, 2008 to September 30, 2011, pursuant to Resolution No. 08-0695, adopted December 13, 2007, for the upgrade of the playground area currently being used by the childcare and after school program. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: Em JULIE 0. BRU iia CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
