Terms of Office
Purpose of Item:
AN ORDINANCE OF THE MLAMI CITY COMMISSION AMENDING CHAPTER 11.5 CIVILIAN
COMPLAINT .INVESTIGATION AND REVIEW, ARTICLE II OF THE CODE, OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, ENTITLED 'THE CITY OF MIAMI CIVILIAN INVESTIGATIVE PANEL,"
MORE PARTICULARLY BY AMENDING SECTION 11.5-28, ENTITLED "MEMBERSHII
;NOMINATION OF MEMBERS; TERMS OF OFFICE AND VACANCIES; APPOINTMENT OF THE CIP
NOMINATING COMMITTEE;" TO AMEND THE MEMBERSHIP, APPOINTMENT PROCESS AND
TERMS OF OFFICE; CONTAINING A SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
Background Information:
This Ordinance will reduce the membership of the CIP from thirteen to nine. The appointments of the
Panel Members will be made by the City Commission directly receiving nominations from the public
rather than nominations being generated solely by the sitting members of the panel. Each District
Commissioner will propose one member; the Mayor will propose two members; the City Manager
will propose one member, all from those nominated by the public. The Chief of Police will have
one appointment (exempt from term limitations). A clearly transparent public process will be
undertaken to solicit for interested parties from the public and ensure chosen nominees are made
available for public inspection and consideration prior to any appointment. No CIP member shall
serve more than two consecutive terms, each term being three years.
