HomeMy WebLinkAboutLegislationCity of Miami City Hall O 3500 Pan American Drive Miami, FL 33133 6„0�' •' d'` Legislation www.miamigov.com Ordinance File Number: 10-00631 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING CHAPTER 2, ARTICLE XI, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADM INISTRATION/BOARDS,COMMITTEES, COMMISSIONS", MORE PARTICULARLY BY CREATING A NEW DIVISION 9 ENTITLED "MIAMI ADVISORY COMMITTEE ON ELEVATE MIAMI;" CONTAINING SECTIONS ESTABLISHING THE COMMITTEE; SETTING FORTH THE TERMS OF THE COMPOSITION OF THE COMMITTEE, QUORUM, AND DUTIES; ASSIGNING STAFF AND LIAISON; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami ("City") desires to better prepare its citizens to participate and compete in the new digital society and digital economy by assisting them in becoming more comfortable with and adaptable to new technologies; and WHEREAS, in pursuit of this aim, the City previously launched a comprehensive and wide-ranging initiative under the name "Elevate Miami" that included four (4) components: (1) Digital Literacy; (2) ACCESS Miami; (3) the Education Compact; and (4) Community Outreach (collectively, the "Program"); and WHEREAS, each component targets the City's youth, low-income families, minorities, seniors, and all residents facing barriers to economic empowerment; and WHEREAS, the Program provides citizens of Miami with: (1) the wealth -building tools necessary for economic self-sufficiency; (2) programs that enhance and support efforts made by the school district with an emphasis on improving student achievement, family involvement, and the student's learning environment; (3) access to technology; (4) computer literacy training; (5) affordable technology packages that include internet access, hardware, software, financing, and related components; and (6) capacity building for community organizations and small businesses; and WHEREAS, the City Commission wishes to establish the Miami Advisory Committee on Elevate Miami ("Committee") to assist in managing and promoting the Program; and WHEREAS, the Committee can also assist in obtaining public and private funding and sponsorships of the Program; and WHEREAS, the Committee can ensure the success of the Program as set forth more particularly below; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and City of Miami Pagel. of 4 File Id. 10-00631 (Version: IJ Printed On: 5117/2010 File Number: 10-00631 incorporated as if fully set forth in this Section. Section 2. Chapter 2/Article XI of the Code of the City of Miami, Florida, as amended, is further amended in the following particulars:{1} "CHAPTER 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS DIVISION 9. MIAMI ADVISORY COMMITTEE ON ELEVATE MIAMI Sec. 2-1121. Created; number of members; function. A Miami Advisory Committee on Elevate Miami is hereby created consisting of nine (9) persons. The basic function of the committee is to assist the mayor, city commission and the city manager in establishing a comprehensive and wide-ranging initiative known as Elevate Miami which includes four (4) components: (1) Digital Literacy; (2) ACCESS Miami; (3) the Education Compact; and (4) Community Outreach. Sec. 2-1122. Composition; terms. (a) The composition of the Miami Advisory Committee on Elevate Miami shall be as follows: (1) Each City Commissioner shall recommend one (1) member subject to appointment by the City Commission. (2) The Mayor shall recommend four (4) members subject to appointment by the City Commission. (3) All members appointed by the City Commission shall serve for a period of one (1) year or until the nominating party leaves office, whichever occurs first. (4) The City's Chief Information Officer shall not be a member of the Committee but shall be informed of and invited to attend each Committee meeting. (5) All members shall be qualified and distinguished by their education, experience and attainments in the information technology profession, education profession, business management, or similar background. (b) All Committee members shall continue to serve until their successors are duly appointed. Sec. 2-1123. Organization; quorum. (a) The Committee shall be convened for its first organizational meeting by the City Manager as soon as is _practical after designation of its members by the City Commission. At that meeting, the Committee shall: (1) Elect a chairperson for a one (1) year term from the date of such election. (3) Establish an annual work program and schedule of actions to be accomplished. (4) Conduct such other business as is deemed necessary to carry out the Committee's duties and obligations. Subsequent annual organizational meetings shall be convened by the chairperson, for the above purposes, prior to the expiration of his or her term as chairperson. (b) The Committee shall elect its own chairperson who shall: (1) Call and conduct all meetings. (2) Be responsible to ensure that notes of all meetings are maintained. (3) Be responsible that the notes of all meetings are forwarded to the Mayor, the City Commission, and the City Manager in a timely fashion. (c) Quorum. Five (5) members constitute a quorum to convene a meeting of the Committee. An affirmative vote of the maiority of the members present and voting at a meeting at which a quorum is present is required for any action to be taken by the members. Sec. 2-1124. Liaison and support services. It shall be the duty of the City Manager to provide liaison with the Committee and support service from the administration. Sec. 2-1125. Duties. The duties of the Committee shall include but not be limited to: (a) Promote the comprehensive and wide-ranging initiative known as Elevate Miami. (b) Assist in obtaining funding and sponsorships from the private and public sector for Elevate Miami. (c) Supervise the development and mission of the Elevate Miami initiative. (d) Make recommendations to the City Commission regarding funding from the general fund for Elevate Miami. (e) Make an annual report to the City Commission concerning the status of Elevate Miami. The format of the report shall include: (1) An overview of the Committee's accomplishments during the year. (2) Planned activities and goals for the following year, if any. (3) A financial report concerning ,the budget of Elevate Miami, which shall include schedules of activity expenditures, a budget for the following year, and an explanation of any expenditures that vary by more than ten percent (10%) from the budget. City of Miami Page 3 of 4 File Id. 10-00631 (Version: 1) Printed On: 5117/2010 File Number.- 10-00631 (4) Certification by the Committee that the reported actual expenditures are true and correct and that, to the best of the members' knowledge, all grant money and other distributions were used in a manner consistent with all federal, state, and local rules, regulations, ordinances, and statutes. (5) An inventory list of all donated items broken down by month that shall include the name of each donor and a brief description of the item donated. (f) Make and adopt any other rules and regulations necessary to carry out the duties described in this section. Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O.
