A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT PARTICIPATION
AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION, IN
SUBSTANTIALLY THE ATTACHED FORM, ACCEPTING THE STATE OF
FLORIDA'S CONTRIBUTION, IN THE AMOUNT OF $619,416, FOR THE
OPERATING AND MAINTENANCE COSTS ASSOCIATED WITH THE
BISCAYNE-BRICKELL TROLLEY SERVICE; AUTHORIZING THE ALLOCATION
OF THE CITY OF MIAMI'S ("CITY'S") REQUIRED MATCHING FUNDS, IN THE
AMOUNT OF $619,416, FROM THE CITY'S SHARE OF THE ONE-HALF CENT
TRANSIT SURTAX PROCEEDS OF THE PEOPLE'S TRANSPORTATION PLAN.
WHEREAS, the City of Miami ("City") was awarded $4,084,282 of Federal Transit Administration
Section 5307 funds allocated by the American Recovery and Reinvestment Act to purchase a fleet of
eco -friendly rubber -tire trolley buses; and
WHEREAS, in an effort to reduce vehicular congestion, improve pedestrian mobility, and enhance
transit service in the Biscayne-Brickell District, the City proposed the Biscayne-Brickell Trolley; and
WHEREAS, the Biscayne-Brickell Trolley will serve the downtown Miami and Brickell areas; and
WHEREAS, the loop extends from Southeast 26th Road in the Brickell area on the south, to
Margaret Pace Park on the north, serving the Brickell, downtown, and Omni areas, Miami, Florida, and
connecting to numerous Metromover stations along the route; and
WHEREAS, additionally, the route will provide an opportunity lot for a Park -and -Ride at Miami
Parking Authority Lots 22 and 23 at the southern terminus of the route; and
WHEREAS, a small extension of the route along North 1stStreet and Flagler Street, Miami,
Florida, will serve the downtown core; and
WHEREAS, the City will be providing extended trolley service during nights and weekends and for
special events in venues along the route such as the Adrienne Arsht Center for the Performing Arts,
the American Airlines Arena, Bayside Marketplace, and Bayfront Park; and
WHEREAS, the Florida Department of Transportation ("FDOT") has tentatively programmed
$619,416 of State of Florida funds for operating and maintenance costs associated with the
Biscayne-Brickell Trolley service; and
WHEREAS, the City is required to provide an equivalent match and enter into a Joint Participation
Agreement ("JPA") for said purpose; and

WHEREAS, matching funds are available from the City's share of the One -Half Cent Transit Surtax
proceeds of the People's Transportation Plan ("PTP"); and
WHEREAS, though finalized, the JPA is being presented to the City Commission as a draft
document, as FDOT will release executable versions at the beginning of their next fiscal year, July 1,
2010; and
WHEREAS, FDOT cannot financially obligate these funds until said date;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1} to execute a JPA with the FDOT, in substantially the
attached form, accepting the State of Florida's contribution, in the amount of $619,416, for the
operating and maintenance costs associated with the Biscayne-Brickell Trolley service.
Section 3. The City's required matching funds, in the amount of $619,416, are allocated from the
City's share of the One -Half Cent Transit Surtax Proceeds of the PTP.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
