HomeMy WebLinkAboutExhibitCERTIFICATION AND DECLARATION OF RESULTS ON 2010 MIMO BUSINESS IMPROVEMENT COMMITTEE (BIC) BUSINESS IMPROVEMENT DISTRICT PETITION PROCESS, MAY 24, 2010 STATE OF FLORIDA COUNTY OF MIAMI DADE ) CITY OF MIAMI I, Priscilla A. Thompson, City Clerk of the City of Miami, Florida do hereby certify that all necessary legal steps were taken in connection with the conduct of the petition process conducted by the MiMo Business Improvement Committee (MiMo BIC) to create the MiMo Business Improvement District (MiMo BID). The MiMo BIC opted to obtain approval of affected property owners through a petition process that included: having property owners file an affidavit with a signature of the property owner or their designee, to be filed with the Office of the City Clerk (Clerk) by 5:00 PM on Monday, May 24, 2010; and, a petition circulated by the MiMo BIC to be filed with the Clerk by 5:00 PM on Friday, May 28, 2010. I. On Thursday, February 11, 2010 A. The City Commission of the City of Miami (Commission) passed Resolution 10-0057 establishing a .special assessment district to be known as the MiMo BID and authorizing the levy and collection of a special assessment for a period of five (5) years, subject to the approval of a majority of the affected property owners of all properties abutting Biscayne Boulevard from NE .61St Street in the south to NE 82nd Street in the North, including Biscayne Plaza Shopping Center and Legion Memorial Park. B. The petition process, per agreement between the MiMo BIC, the Office of the City Attorney (Attorney) and the Clerk included affidavits to be filed with the Clerk by Friday, April 16, 2010 no later than 5:00 pm and petitions to be filed with the Clerk no later than 5 pm on Friday April 30, 2010. C. The MiMo BIC mailed affected property owners within the MiMo area, as described in I. A., above, packets of information including general information about business improvement districts, the MiMo area, the assessment roll, blank affidavits and petitions and filing instructions. H. On Thursday, April 8, 2010 A. The Commission passed Resolution 10-0164 rescinding Resolution 10-0057 and establishing a special assessment district to be known as the MiMo BID and authorizing the levy and collection of a special assessment for a period of five (5) years, subject to the approval of a majority of the affected property owners of all properties abutting Biscayne Boulevard from NE 61" Street in the south to NE 82nd Street in the North, including properties located on the south side of NE 61St Street and excluding properties located on the north side of NE 82nd Street. B. The MiMo BIC opted to obtain approval of the affected property owners through a petition process. Per agreement between the MiMo BIC, the Attorney and the Clerk the processes include affidavits to be filed with the Clerk by Friday, May 24, 2010 and petitions to be filed with the Clerk no later than 5 pm on Friday May 28, 2010. C. The MiMo BIC mailed affected property owners within the MiMo area, as described in II. A., above, packets of information including general information about business improvement districts, the MiMo area, the assessment roll, blank affidavits and petitions and filing instructions. III. On Thursday, April 22, 2010 A. The Commission passed Resolution 10-0170 rescinding Resolution 10-0164 and establishing a special assessment district to be known as the MiMo BID and authorizing the levy and collection of a special assessment for a period of five (5) years, subject to the approval of a majority of the affected property owners of all properties abutting Biscayne Boulevard from NE 61St Street in the south to NE 82nd Street in the North, including properties located on the south side of NE 61St Street and excluding properties located on the north side of NE 82nd Street. B. The MiMo BIC opted to obtain approval of the affected property owners through a petition process. Per agreement between the MiMo BIC, Attorney and the Clerk the processes include affidavits to filed with the Clerk by Friday, May 24, 2010 and petitions to be filed with the Clerk no later than 5 pm on Friday May 28, 2010. C. The MiMo BIC mailed affected property owners within the MiMo area, as described in III. A., above, packets of information including general information about business improvement districts, the MiMo area, the assessment roll, blank affidavits and petitions and filing instructions. IV. I further certify that upon May 24, 2010 at 5:00 P.M., the agreed upon deadline for the Clerk to have received affidavits from owners of the one hundred and fifteen (115) affected properties of the proposed MiMo BID, a total of twenty five (25) affidavits had been filed with my Office. V. I further certify that the 25 affidavits filed represent 21.74% of the properties within proposed special assessment district and therefore do not represent a majority of the affected property owners stipulated by Resolution 10-0170.
