OrripSOIl, CMC REFERENCES City Clerk ENCLOSURES: Certification of Petition Process Enclosed is the official certification of the results of MiMo Business Improvement Committee's petition process to create the MiMo Business Improvement District. On Thursday, April 22, 2010 the Conunission passed Resolution 10-0170 establishing a special assessment district to be known as the MiMo BID and authorizing the levy and collection of a special assessment for a period of five (5) years, subject to the approval of a majority of the affected property owners. The MiMo BIC opted to obtain approval of the affected property owners through a petition process. Per agreement between the MiMo BIC; the City Attorney and the City Clerk this process included affidavits to be filed with the Clerk by 5:00 pm, Monday, May 24, 2010 and petitions to be filed with the Clerk no later than 5:00 pm on Friday May 28, 2010. The MiMo BIC mailed affected property owners within the MiMo area packets of information including: general information about business improvement districts and the MiMo area; the assessment roll; blank affidavits; and petitions and filing instructions. On May 24, 2010 at 5:00 P.M., the agreed upon deadline for the Clerk to have received affidavits from owners of the one hundred and fifteen (115) affected properties of the proposed NEW BID, a total of twenty five (25) affidavits had been filed with the Office of the City Clerk and zero (0) signatures via petitions were filed on Friday May 28, 2010. The number of affidavits filed represented 21.74% of the affected properties within proposed special assessment district and therefore did not represent a majority of the affected property owners stipulated by Resolution 10- 0170. c : Carlos A.
