HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution File Number: 10-00643 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY, THROUGH THE MIAMI-DADE TRANSIT AGENCY, IN SUBSTANTIALLY THE ATTACHED FORM, TO ACCEPT AND USE FEDERAL TRANSIT ADMINISTRATION ("FTA") SECTION 5307 FORMULA GRANT FUNDS, IN THE AMOUNT OF $4,084,282, PROVIDED TO THE CITY OF MIAMI ("CITY") BY THE AMERICAN RECOVERY AND REINVESTMENT ACT AS PART OF THE FEDERAL STIMULUS PACKAGE FOR A TRANSIT CAPITAL PROJECT CONSISTING OF PURCHASING RUBBER -TIRE TROLLEY BUSES (B-30668); FURTHER AUTHORIZING THE CITY MANAGER TO IMPLEMENT THE ACCEPTANCE OF SAID CONTRIBUTION OF FUNDS FROM THE FTA, TO BE APPROPRIATED BY SEPARATE RESOLUTION(S). WHEREAS, the City of Miami ("City") applied for a federal grant as part of the federal stimulus package for transit projects; and WHEREAS, Federal Transit Administration ("FTA") Section 5307 funds, in the amount of $4,084,282, have been allocated to the City by the American Recovery and Reinvestment Act ("ARRA") for a transit capital project; and WHEREAS, the City's transit project consists of purchasing rubber -tire trolley buses and ancillary capital equipment which will be used to operate municipal circulator services, Project B-30668 ("Project"); and WHEREAS, the Miami -Dade Transit Agency ("MDT") is the designated recipient of federal transit funds in Miami -Dade County ("County") and will serve as the local pass-through agency for the FTA Section 5307 funds to be provided to the City by the ARRA; and WHEREAS, an Interlocal Agreement with MDT will be required in order to access the Federal Section 5307 funds to be provided to the City; and WHEREAS, no matching funds and no contribution from the General Fund will be required by the acceptance of the federal stimulus/ARRA funds and execution of the Interlocal Agreement, attached and incorporated; and WHEREAS, all ensuing agreements and contracts executed pursuant to this Resolution will be subsequently brought before the City Commission for approval; and WHEREAS, the federal stimulus/ARRA funds provided by FTA through MDT will be appropriated by separate resolution(s); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miami Page I of 2 File Id: 10-00643 (Version: 1) Printed On: 5126/2010 File Number: 10-00643 FLORIDA: Section 1. The recitals and findings found in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute the Interlocal Agreement with the County, through MDT, in substantially the attached form, to accept and use FTA Section 5307 formula grant funds, in the amount of $4,084,282, provided to the City by the ARRA as part of the federal stimulus package for the Project. Section 3. The City Manager is further authorized (1) to implement the acceptance of said contribution of funds from the FTA, to be appropriated by separate resolution(s). Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS JULIE 0. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that maybe imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
