A RESOLUTION OF THE MIAMI CITY COMMISSION, BY FOUR-FIFTHS (4/5THS)
AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF AN
EMERGENCY, PURSUANT TO SECTIONS 18-89 AND 18-90 OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING COMPETITIVE SEALED
BIDDING PROCEDURES BY FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, FOR
THE CONTINUED RENTAL OF A ONE HUNDRED (100) TON AIR COOLED
CHILLER FOR THE MANUEL ARTIME COMMUNITY CENTER AS AN EMERGENCY
PROCUREMENT UNTIL PERMANENT REPAIRS ARE COMPLETED IN FULL, FOR
ATWO (2) MONTH PERIOD, IN A MONTHLY AMOUNT OF $4,500, AND ATOTAL
CONTRACT AMOUNT NOT TO EXCEED $9,000, TO AGGREKO, LLC., UNDER
THE SAME PRICE, TERMS AND CONDITIONS SET FORTH WITHIN INVITATION
FOR QUOTATION NO. 194156; ALLOCATING FUNDS FROM MANUELARTIME
CAPITAL IMPROVEMENT PROJECT B# 30501-A.
WHEREAS, on April 18, 2008, a new air conditioning handler unit, chiller, and expansion tank
were installed at the Manuel Artime Community Center; and
WHEREAS, after twenty (20) months of ownership, the coils within the chiller have rusted,
causing the entire system to be inoperable; and
WHEREAS, the continued rental of the portable chiller is necessary until such time that Carrier
honors its warranty obligations and permanent repairs are initiated and completed to the twenty (20)
month old chiller unit; and
WHEREAS, the Department of Purchasing initiated an informal bidding process by issuing
and Invitation for Quotation ("IFQ") No. 194156 for the monthly rental of a one hundred (100) ton air
cooled chiller and awarded it to Aggreko, LLC., the sole responsive and responsible bidder; and
WHEREAS, it has been determined that it is necessary to continue the rental of the one
hundred (100) ton air cooled chiller from Aggreko, LLC., under the same price, terms and conditions
set forth within IFQ No. 194156, as it is essential to the life, health, welfare, safety, and convenience
for the tenants and patrons of the Manual Artime Community Center; and
WHEREAS, the City Manager approved the Department of Public Facilities' emergency finding
and determined that it was in the best interest of the City to waive the competitive sealed bidding
procedures pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended ("City
Code");
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's findings of an emergency, pursuant to Section 18-89 and 18-90 of the City Code, are
ratified, approved and confirmed, and by a four-fifths (4/5ths) affirmative vote, the requirements for
competitive sealed bidding procedures, as stipulated in Section 18-85, of the City Code, are waived,
for the continued rental of a one hundred (100) ton air cooled chiller for the Manuel Artime Community
Center as an emergency procurement until permanent repairs are completed in full, for a two (2)
month period, in a monthly amount of $4,500, and a total contract amount not to exceed $9,000, to
Aggreko, LLC., under the same price, terms and conditions set forth within IFQ No. 194156, with
funds allocated from Award Nos. 1212, 1350, and 1426 within Manuel Artime Capital Improvement
Project B# 30501-A.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
by the Mayor.{1 }
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
