HomeMy WebLinkAboutR-10-0186Vop City of Miami F .. 19611F A111 *'Ir Legislation i 0 R �O Resolution: R-10-0186 File Number: 10-00557 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/13/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH PARKLANE TOWERS, LLC, FOR THE CITY OF MIAMI'S USE OF THE PARK LANE TOWERS SITE LOCATED AT 345 NORTHEAST 32ND STREET, MIAMI, FLORIDA, AS A PASSIVE PARK WHICH WILL BE MAINTAINED BY PARKLANE TOWERS, LLC, WITH CONDITIONS AS STATED MORE PARTICULARLY IN SAID AGREEMENT. WHEREAS, Parklane Towers, LLC ("Owner/Developer") is the owner of the two real properties described in Composite "Exhibit A", attached and incorporated (referred to as "Project Sites"); and WHEREAS, the Project Sites each obtained a Major Use Special Permit approval, Park Lane Towers, pursuant to Resolution No. 05-0349, adopted May 26, 2005, and 1550 Chelsea, pursuant to Resolution No. 06-0190, adopted March 23, 2006, as same may be modified from time to time (collectively, "Resolutions"), which authorizes certain developments to occur on the Project Sites, said developments being hereinafter referred to as the "Projects"; and WHEREAS, the City of Miami ("City") desires to use a the Park Lane Towers site located at 345 Northeast 32nd Street, Miami, Florida, for a passive park as depicted in "Exhibit B", attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute a License Agreement, in substantially the attached form, with the Owner/Developer for the City's use of the Park Lane Towers site located at 345 Northeast 32nd Street, Miami, Florida, as a passive park which will be maintained by the Owner/Developer, with conditions as stated more particularly in said Agreement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miand Page 1 of 2 File Id. 10-00557 (Version: 2) Printed On: 7/27/2017 File Number: 10-00557 Enactment Number: R-10-0186 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
