ChiefCity Manager' Page I of 2 Subject: License Agreement with the Miami -Dade County Aviation Department for the use of space at five city of Miami parks Background Information: On May 24, 2007, the City Commission adopted Resolution No. 98-755, which authorized the City Manager to execute a License ("License") with the Miami -Dade County Aviation Department ("Licensee"), for the purpose of installing, operating and maintaining noise monitoring equipment at five city parks (Kinloch Municipal Park, Bryan Park, Wainwright Park, Morningside Park and Dawkins Park) for the purpose of detecting and measuring noise levels on the ground generated by aircraft in the vicinity of Miami International Airport. The initial term of the License was five years with one option to renew for an additional five-year term. The License has since expired. The City of Miami ("City") and the Licensee wish to enter into this License for a period of five years, effective February 1, 2009, with the option to renew for one successive term of five years. A new License with the Licensee will allow for the continued operation of the noise monitoring equipment located at the five aforementioned city parks. The permanent monitoring equipment, along with radar tracking equipment, will provide the Licensee with immediate information regarding flight paths and plane noise. According to the Licensee, the system can identify which airlines are veering off their flight plans. It can also show if they are flying too close to the ground. Furthermore, the system assists the Licensee with investigating complaints from City residents and provides that airlines maintain their assigned flight plans. The monitoring equipment assists the Licensee with compiling documentation to provide the Federal Aviation Administration ("FAA") in order to request that flight paths be altered, if needed. There are currently twenty-four noise monitoring devices installed throughout Miami -Dade County for which the Licensee is not charged a fee. The City is kept informed as to the information gathered by the monitoring equipment through a monthly report detailing the problems identified and the method of solution. This report is typically provided to the representative designated by the mayor to represent the city at monthly meetings coordinated by the Licensee. Licensee is simultaneously presenting this License to the Miami -Dade County Board of Commissioners for oval at the meeting scheduled for May 4, 2010. Page 2 of 2
