A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE AGREEMENT
("LICENSE"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY
OF MIAMI, ("CITY') AND THE MIAMI-DADE COUNTY AVIATION DEPARTMENT, AN
ADMINISTRATIVE AGENCY OF MIAMI-DADE COUNTY, A POLITICAL
SUBDIVISION OF THE STATE OF FLORIDA, FOR THE PURPOSE OF OPERATING
AND MAINTAINING NOISE MONITORING EQUIPMENT TO BE LOCATED AT FIVE
CITY PARKS, FOR THE PURPOSE OF DETECTING AND MEASURING NOISE
LEVELS ON THE GROUND GENERATED BY AIRCRAFT IN THE VICINITY OF
MIAMI INTERNATIONAL AIRPORT, FOR ATERM OF FIVE (5) YEARS, WITH AN
OPTION TO RENEW FOR ONE (1) ADDITIONAL FIVE-YEAR TERM, AT NO
CHARGE, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET
FORTH IN THE LICENSE; FURTHER AUTHORIZING THE CITY MANAGER TO
APPROVE AND EXECUTE NON -SUBSTANTIVE AMENDMENTS TO SUCH
LICENSE AS NEEDED.
WHEREAS, pursuant to Resolution No. 98-755, adopted July 14, 1998, the City Commission
authorized the City Manager to enter into a License Agreement (the "License"), effective February 1,
1999, with Miami -Dade County (the "Licensee"), for the purpose of installing, operating and
maintaining noise monitoring equipment at five City of Miami ("City") parks (Kinloch Municipal Park,
Bryan Park, Wainwright Park, Morningside Park, and Dawkins Park) for the purpose of detecting and
measuring noise levels on the ground generated by aircraft in the vicinity of Miami International
Airport; and
WHEREAS, the License has expired and the Licensee wishes to pursue a new Licensee with the
City; and
WHEREAS, the operation of the noise monitoring equipment located at the five City parks will
facilitate and assist the Licensee in its response to the concerns and complaints of residents of the
City; and
WHEREAS, the City and the Licensee wish to enter into this License for a period of five (5) years,
with the option to renew for one successive term of five years;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a License, in substantially the attached
form, between the City and the Licensee, an administrative agency of Miami -Dade County, a political

subdivision of the State of Florida, for the purpose of operating and maintaining noise monitoring
equipment to be located at five City parks, for the purpose of detecting and measuring noise levels on
the ground generated by aircraft in the vicinity of Miami International Airport, for a term of five (5)
years with an option to renew for one (1) additional five-year term, at no charge, with terms and
conditions as more particularly set forth in the License.
Section 3. The City Manager is further authorized{1} to approve and execute non -substantive
amendments to such License as needed.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
