The previous license agreement expired January 31, 2009 and authorized the Aviation Department to install, maintain and operate noise -monitoring equipment within certain City parks to detect and measure noise levels on the ground generated by aircraft adjacent to Miami International Airport. The new license agreement would be for a term of five years, with the City Manager having the authority to extend the term for an additional period of five years, if additional monitoring is required and requested at least ninety (90) days prior to the termination if the agreement. At this time, the Asset Management Division is requesting your decision as to the Aviation Department's request. The purpose of this agreement was to authorize the Aviation Department to install, maintain, and operate noise -monitoring equipment within certain City Parks to detect and measure noise levels on the ground generated by aircraft adjacent to Miami International Airport. The agreement was for a term of five years with the City Manager having the authority to extend the term for an additional period of five years if additional monitoring is required and requested by Miami Dade at least ninety (90) days prior to the termination date of the agreement. To date, and despite contact by Asset Management staff, the City has not received communication from the Aviation Department requesting that it would like to pursue a new agreement with the City to allow for the continued maintenance and operation of noise -monitoring equipment within certain City Parks. If you have received such information, then please contact this office immediately. Otherwise, the Aviation Department will be provided with a letter notifying it of the agreement's expiration and directing it to remove all equipment, pursuant to the agreement.
