HomeMy WebLinkAboutR-10-0173Vop City of Miami Legislation < U R �O Resolution: R-10-0173 File Number: 08-01084xc City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 4/22/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING A SPECIAL EXCEPTION, REQUIRING CITY COMMISSION APPROVAL, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 6, SECTION 612, "SD -12" SPECIAL BUFFER OVERLAY DISTRICTS, CONDITIONAL ACCESSORY USES, TO ALLOW SURFACE PARKING TO SERVE ABUTTING DISTRICT, SUBJECT TO ALL APPLICABLE CRITERIA; WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED SUBJECT TO CONDITIONS, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 2508, 2524, 2534, 2538, 2590, 2600, 2610 AND 2620 SOUTHWEST 5TH STREETAND THREE UNASSIGNED ADDRESSES, HAVING FOLIO NUMBERS 01-4103-037-0280, 01-4103-037-0430 AND 01-4103-037-0431, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board, at its meeting on April 12, 2010, following an advertised public hearing, adopted Resolution No. ZB-R-10-022 by a vote of five to zero (5-0), item no. Z.1, recommending APPROVAL with a condition that the applicant shall provide a revised landscape plan showing separation between the turn around access way and the existing building and separation between the parking row and the existing building on the west and south side of the proposed parking lot and that the proposed hedge species and quantity is clearly indicated on the plan prior to the issuance of any building permits, of a Special Exception requiring City Commission approval as set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, finds the application for the Special Exception meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to reverse the decision of the Zoning Board and grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The decision of the Zoning Board to approve with a condition the Special Exception as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 6, Section 6, 612, "SD -12" Special Buffer Overlay Districts, to allow surface parking to serve abutting district, subject to all applicable criteria, for the properties located at approximately 2508, 2524, 2534, City of Miand Page 1 of 5 File Id. 08-01084.vc (Version: 2) Printed On: 7/27/2017 File Number: 08-01084xc Enactment Number: R-10-0173 2538, 2590, 2600, 2610 and 2620 SW 5th Street and three unassigned addresses, having Folio Numbers 01-4103-037-0280, 01-4103-037-0430 and 01-4103-037-0431, Miami, Florida, legally described in attached "Exhibit A," pursuant to plans on file and subject to a time limitation of twelve (12) months in which a building permit must be obtained, subject to conditions, and the Special Exception granted. Section 3. The findings of fact set forth below are made with respect to the subject property: a. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1 } Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
