A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO PURCHASE THE ROCKERMAN CANAL IN COCONUT GROVE,
FLORIDA ("ROCKERMAN CANAL"), FOR THIRTY-TWO THOUSAND FOUR
HUNDRED FORTY-TWO DOLLARS AND FORTY SEVEN CENTS ($32,442.47), AS
CONTEMPLATED IN RESOLUTION NO. 10-0034, ADOPTED JANUARY 28, 2010;
ALLOCATING FUNDS FROM ACCOUNT NO. 1124.40.B30680; AUTHORIZING THE
CITY MANAGER TO ACCEPT A DEED, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR THE ROCKERMAN CANAL; FURTHER AUTHORIZING THE
RECORDATION OF SAID DEED IN THE PUBLIC RECORDS OF MIAMI-DADE
COUNTY, FLORIDA.
WHEREAS, the City of Miami ("City") owns the shoreline on the south side of the "Rockerman
Canal" located on the north side of David T. Kennedy Park, east of South Bayshore Drive, Miami,
Florida, and is responsible for the maintenance of that portion of the Rockerman Canal and control of
the storm water run-off from the City park into the Rockerman Canal; and
WHEREAS, the City has negotiated an agreement, formalized by the creation of a Special
Assessment District, with the homeowners on the north side of the Rockerman Canal to share the
maintenance responsibility for the Rockerman Canal; and
WHEREAS, acceptance of a deed for the ownership of the Rockerman Canal is essential in order
to apply for the required environmental permits to properly maintain the canal, apply for funding
grants and to provide the general public with the recreational access to the Rockerman Canal from
David T. Kennedy Park;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to purchase the Rockerman Canal for Thirty -Two
Thousand Four Hundred Forty -Two Dollars and Forty Seven Cents ($32,442.47), as contemplated in
Resolution No. 10-0034, adopted January 28, 2010, with funds allocated from Account No.
1124.40.B30680.
Section 3. The City Manager is authorized{1} to accept a deed, in a form acceptable to the City
Attorney, for the Rockerman Canal located on the north side of David T. Kennedy Park, east of South
Bayshore Drive, Miami, Florida.
Section 4. The City Manager is authorized{1} to cause the recordation of said deed in the Public
Records of Miami -Dade County, Florida.

Section 5. This Resolution shall become effective immediately upon its adoption and signature by
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor votes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
