Final Action Date:
A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
URGING GOVERNOR CHARLIE CRIST AND THE MEMBERS OF THE FLORIDA
CABINET SERVING AS THE BOARD OF TRUSTEES OF THE INTERNAL
IMPROVEMENT TRUST FUND ("STATE OF FLORIDA") TO REVERT THE LAND
COMMONLY REFERRED TO AS THE "COCONUT GROVE PLAYHOUSE" BACK
TO THE STATE OF FLORIDA AS A RESULT OF THE RESTRICTIONS IN THE
QUITCLAIM DEED, ATTACHED AND INCORPORATED; URGING THE STATE OF
FLORIDA TO THEN CONVEY THE COCONUT GROVE PLAYHOUSE TO A TO -BE
NEWLY FORMED NOT FOR PROFIT CORPORATION CALLED "THE GROVE
PLAYHOUSE THEATRE, INC."; FURTHER DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF THIS RESOLUTION TO THE HEREIN DESIGNATED
OFFICES.
WHEREAS, as a result of various Leases and Memorandums of Understanding the Coconut'
Grove Playhouse Property was used by the Players State Theatre, Inc. and its successor, the Coconut
Grove Playhouse, Inc., for theatrical presentations; and
WHEREAS, in the deed from the State of Florida to the Coconut Grove Playhouse, LLC
("Grantee") of June 28, 2004, the Playhouse Property was restricted for use only for theater, theatrical
productions, theatrical education and related arts activities; and
WHEREAS, the Playhouse Property has been "dark" for many years and has remained closed and
is not functioning as a public theater for patrons, guests and the public at large; and
WHEREAS, the state may give written notice to the Grantee that the restrictions in the deed have
been violated and if such violations are not cured, it is recommended that the State of Florida take all
appropriate measures to revert the Playhouse Property back to the State of Florida at this time; and
WHEREAS, the Grove Playhouse Theatre, Inc., a to -be newly formed corporation, has the
integrity, desire, will, and ability to successfully operate a public theatre on the Playhouse Property if
the playhouse property is transferred to it;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission urges Governor Charlie Crist and the members of the
Florida Cabinet to revert the land commonly referred to as the "Coconut Grove Playhouse" back to the

Section 3. The Miami City Commission further urges the State of Florida to then convey the
Coconut Grove Playhouse to a to -be newly formed corporation not for profit called "The Grove
Playhouse Theatre, Inc."
Section 4. The City Clerk is directed to transmit.a copy of this Resolution to Governor Charlie
Crist, and the members of the Florida Cabinet.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1 }

{1 } If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
