HomeMy WebLinkAboutLegislation.� a UP afI City of Miami Legislation Resolution File Number: 10-00258 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER AND THE EXECUTIVE DIRECTOR OF THE BAYFRONT PARK MANAGEMENT TRUST ("TRUST"), TO ENTER INTO A TRI -PARTY JOINT PARTICIPATION AGREEMENT ("JPA"), WITH THE DOWNTOWN DEVELOPMENT AUTHORITY ("DDA"), IN SUBSTANTIALLY THE ATTACHED FORM, FOR A CAPITAL IMPROVEMENT PROJECT ENTITLED "BICENTENNIAL PARK MOORING BOLLARDS, B -30538A"; ACCEPTING THE CONTRIBUTION OF FUNDS BY THE TRUST, IN THE AMOUNT NOT TO EXCEED $150,000, AND ACCEPTING THE CONTRIBUTION OF FUNDS BY THE DDA, IN THE AMOUNT NOT TO EXCEED $150,000, IN FURTHERANCE OF THE PROJECT, AS STATED HEREIN. WHEREAS, the Bayfront Park Management Trust ("Trust"), the City of Miami ("City"), and the Downtown Development Authority ("DDA") wish to facilitate the construction of a marine improvement project, entitled "Bicentennial Park Mooring Bollards Project, B -30538A", ("Project"); and WHEREAS, the Project scope includes construction of ten (10) in water mooring bollards along the northern edge of the Florida East Coast Railway slip adjacent to Bicentennial Park to accommodate the mooring of large vessels, for which construction is anticipated to include steel reinforced concrete auger piles with reinforced concrete pile caps to allow the placement of bolted -on iron mooring bollards; and WHEREAS, the Trust and DDA wish to utilize the resources of the City in order to contract, construct and administer the Project; and WHEREAS, the Trust agrees to support the City's efforts by providing funding, in the amount not to exceed $150,000, from the Trust's Fiscal Year 2009-2010 Capital Improvement Budget; and WHEREAS, the DDA also agrees to support the City's efforts by providing funding, in the amount not to exceed $150,000; and WHEREAS, the attached Joint Participation Agreement ("JPA") has been negotiated between the Trust, the DDA and the City, detailing the responsibilities of each party; and WHEREAS, the Trust's and DDA's contribution are to be appropriated by separate Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2. The City Manager and Executive Director of the Trust are authorized{1} to enter into a tri -party JPA with the DDA, for the Project, with the City designing, constructing, and administering the Project, utilizing funds contributed by the Trust, in the amount not to exceed $150,000, and funds contributed by the DDA, in the amount not to exceed $150,000, to be appropriated by separate Resolution. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS:/ JULIE O. BRU CITY ATTORNEY { Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission..
