Bru, City Attorney r� DATE: February 17, 2010 RE: Proposed First Reading Ordinance February 25, 2010 City Commission Meeting Amending City Code Sections 42-121 and 42-122 (File 10-00191) The attached ordinance has been drafted in anticipation of the reinstitution of the vehicle impoundment program ("VIP Program"). The amount of the civil penalty was one of the issues that was litigated from the very beginning of the lawsuit challenging the VIP Program, and while the court in City of Miami v. Welllman, 976 So.2d 22 (Fla. 3d DCA 2008) did not specifically indicate that the amount of the penalty must be changed, this Office has determined that it would be in the best interest of the City of Miami to reduce the amount of the civil penalty from $1000 to $500.
