HomeMy WebLinkAboutLegislation,4 City of Miami r "� "" ' ` Y `C Legislation or. 1����,.. `✓ Resolution File Number: 10-00189 RE. 13 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR-FIFTHS (415THS) AFFIRMATIVE VOTE, GRANTING AN INCREASED DURATION OF A SINGLE EVENT BY CLASS 1 SPECIAL PERMIT (BEYOND THE TWO (2) WEEKS ALLOWED PER EVENT), FOR THE PEACOCK TOUR IN THE COCONUT GROVE TO BE LOCATED AT THE ADDRESSES DEPICTED IN "EXHIBIT A", ATTACHED AND INCORPORATED; SPECIFICALLY TO ALLOW THE PLACEMENT OF A SERIES OF PEACOCK SCULPTURES AS A COMMUNITY WIDE EVENT FOR A DURATION OF UP TO SIX (6) MONTHS COMMENCING IN APRIL, 2010 THROUGH AUGUST, 2010; WITH SAID CLASS I SPECIAL PERMIT SUBJECT TO REVIEW AND APPROVAL BY THE ZONING ADMINISTRATOR AS SET FORTH IN ARTICLES 13 AND 14 OF THE ZONING CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; AUTHORIZING THE CITY MANAGER TO WAIVE ALL CLASS i SPECIAL PERMIT FEES FOR SUCH EVENT. WHEREAS, the applicable provisions of Section 906.9 of the Zoning Ordinance of the City of Miami, Florida, as amended ("Zoning Code"), provide, in part, that (unless approved by a four-fifths (4/5ths) affirmative vote of the City Commission waiving this requirement) no individual event shall have a duration of more than two (2) weeks, unless authorized for such by the City Commission; and WHEREAS, the City of Miami is committed to participating in community wide events to promote Coconut Grove; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, an increased duration of a single event by Class I Special Permit (beyond the two (2) weeks allowed per event), is granted, for the Peacock Tour event in the Coconut Grove area to be located at the addresses listed in "Exhibit A", attached and incorporated, specifically to allow a series of Peacock Sculptures as a community wide event for a period of six (6) months commencing in April, 2010 through August, 2010, with said Class I Special Permit subject to review and approval by the Zoning Administrator as set forth in Articles 13 and 14 of the Zoning Code. Section 3. The City Manager is authorized{1) to waive all Class I Special Permit fees for such event. Section 4. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
