RESOLUTION NO. 02— 422
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMWT(S), AUTHORIZING THE CITY
MANAGEXR TO VXECUTE THE LICIVSE AGREEMENT FOR
PROPRIETARY soMARE PRODUCTS, IN
SUBSTANTIALLY THE ATTACHED FORM. WITH B k L
ASSOCIATES, INC. FOR CONTINUED RE -LICENSING,
TRAININO, MAIN'TENANCS AND PRODUCT SUPPORT OF
ITS PROPRIETARY SOFTWARE FOR THE DEPARTMENT
OF INFORMATION TECHNOLOGY, ON A CONTRACT
BASIS FOR A ONE-YEAR PERIOD, WITH THE OPTION
TO RENEW FOR TWO ADDITIONAL ONE-YEAR PERIODS,
AT AN ANNUAL AMOUNT NOT TO EXCEED 555,000,
WITH ANNUAL MAINTENANCE INCREASES NOT TO
EXCEED FOUR PERCENT (4t) PER YEAR; ALLOCATrNG
FUNDS FROM ACCOUNT CODE
NO. 001000.460101.6.670, SUBJECT TO BUDGETARY
APPROVAL.
WHEREAS, the Department of Information Technology
("Information Technology") is seeking approval to execute a
License Agreement for Proprietary Software Products
('AGR.EEMENT'), in subetarntzally the attached form, with H 6 L
Asaociatas, Inc, for continued maintenance of the software
SL/Lib, SL/Roto, BL/Viewer, SL/Pack, BL/Schad and SL/Piet; and
WHEREAS, Information Technology hav used BZ/Lib, HL/Pack,
and BL/Schad since 1964 as these products allow the Department to

autolnaticaily schedule jobs in a flexible, efficient, and
effective manner, and aL/Rovo, BL/Viewer, and 8L/Diet purchaaed
in 1996 allows the Department to retrieve tapeta through the use
of robotic technology and create user reports for reviewing and
distribution with the use of a PC; and
wHERBAS, it is neceesary to receive all software maintenance
support for the products From B & L Associates, Inc., as HL/Lib,
BL/Robo, HL/Viewer, &L/Pack, BL/Sched and BL/Dust software
products being utilized by the City of Miami are solely owned and
marketed by E b L Associates, Inc,; and
WHEREAS, funding for Che re -licensing and maintenance of
this software ie allocAted from Account Code
No, 001000.460201.6.670;
NOW, THEREFOR&, BE IT RESOLVED BY THE COMMISSION OF THE CITY
of MSAMI, FLORxvA:

Section 1. The recitalo and findings contained in the
Preamble to Ouv Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is AuthOTizedl' to execute a
License Agreement for Proprietary Software Producte, in
substantially the Attached form, with B L L Associates, Inc., for
continued re -licensing, training, maintenance and product support
of Its proprietary software for the bepartment of Information
Technology, on a contract baa4s for a one-year period, with the
option to renew for two additional one-year periods, in an annual
amount not to exceed $55,000, with annual maintenance increases
not to exceed four percent (0) per year, with funding allocated
from Account. Code No, 001000.460101.6.670, subject to budgetary
approval.
section -3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.21
'-� The herein authorization is further aubject to compliance with
all requiremente that may be imposed by the City Attorney,
including but not limited to those prescribed by appllcsbla City
Charter and Code provisions.
If the Mayor does not sign this Resolution, it shall become
effective at the and of ten calendar days from the date it was
paaacd and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Comuieslon.
