We, the undersigned, are abutting and adjoining property owners of a T-shaped alley —
hereafter, called "alley" — it has Biscayne Blvd at the west end, goes east to The Hamilton,
exits for vehicles on its northeast end into NE 35h Street, and exits for pedestrians (but not
cars) at the southeast end into NE 341' Street.
We ask THE RECENT BAN ON TRUCKS IN THE ALLEY BE RESCINDED, and
STRONGLY OBJECT TO ANY ADDITIONAL CHANGES which might limit pedestrian or
vehicular access into or out of this public -access alley. The reasons are:
1. Of major significance, any closing would pose a serious safety issue as it closes the only
alternate ingress and egress for emergency vehicles and people, should NE 351hStreet become
blocked at Biscayne, or blocked along most of the length of NE 351hStreet. Or, an emergency
requires more access into or out of NE 35th Street than this one (otherwise dead-end) street can
handle.
2. The recent limitation on truck use, and further limitations on use of the alley, constitutes an
infringement of the undersigned's right of way of use, for ourselves and our tenants.
3. Action already taken (No Trucks Allowed) requires that clumpsters which were previously placed
in the alley, for trash pick-up, now must be be placed on NE 35th Street for pick-up. This greatly
enhanced visibility, has resulted in these private clumpsters now, much more often, being used by
non -owners using it as though these are public clum psters. Also, having dumpsters on NE 35thSt.,
is unsightly and decreases property values for all.
4. NE 351hSt is under 30 feet wide (outside curb to curb). i Since narrow, the street sometimes gets
blocked by truck loading; the alley's unnecessary truck ban, increased this problem.
5. The alley serves a recreational use for pedestrians (those with and without dogs), walking east/
west; and for those wanting to walk north/south, close to the water, it enables them to do so
without walking all the way to Biscayne.
6. We strongly object to claims that the alley is any less safe, or more poorly kept up, then has
been the case for decades. in fact, as the area has gentrified, many fewer homeless hang out in
this alley then even a few years ago. (Apparently, banning trucks in the alley was instituted by one
property owner. We received no notice of this use change, as may be required by law.)
7. The undersigned property owners pay significant real estate taxes, annually. Some of us
purchased these properties specifically because they adjoined the alley. Limiting use of the alley,
limits future development rights for property owners abutting, and potentially for also those
adjoining, the alley.
8. Street parking on NE 36h street has become more challenging (meters added recently did not
help). Parking needs will increase over time, as the area grows further to meet allowable
maximum densities. Alley parking mitigates this problem. But, should parking in the alley be further
restricted, or eliminated, it will put increased parking pressures on NE 35th street The result. unnec-
essary parking problems for those residing on the north and south sides of NE 35th street.
9. The alley will become even more essential for all of the above needs (not just #9).
Should any additional alley changes affecting access be considered in spite of this petition,
petitioners herein request 30 days prior written notice — to at least all parties who have signed this
petition — of any relevant meeting. Submitted into the public
