HomeMy WebLinkAboutR-10-0091Vop City of Miami F .. 19611F A111 *'Ir Legislation i 0 R �O Resolution: R-10-0091 File Number: 10-00181 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 3/11/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO EXTEND TO MARCH 25, 2010, THE CURRENT AGREEMENT TO ENTER INTO GROUND LEASE ("AGREEMENT TO ENTER"), BETWEEN THE CITY OF MIAMI ("CITY") AND FLAGSTONE ISLAND GARDENS, LLC ("FLAGSTONE"), IN ORDER TO CONTINUE NEGOTIATING THE MATTER FOR CONSIDERATION AT THE MARCH 25,2010 CITY COMMISSION MEETING. WHEREAS, on January 28, 2010 in connection with Mayor's Discussion Item No. 10-00089, the City Commission authorized until the March 11, 2010 City Commission meeting an extension of the expiring Agreement to Enter Into Ground Lease ("Agreement to Enter") between the City of Miami ("City") and Flagstone Island Gardens, LLC ("Flagstone") in order to permit further negotiations regarding the terms and conditions of extension; and WHEREAS, the parties are continuing to negotiate and have requested for the matter to be extended and continued until consideration at the March 25, 2010 City Commission meeting; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1 } to extend to March 25, 2010, the current Agreement to Enter between the City and Flagstone in order to continue negotiating the matter for consideration at the March 25, 2010 City Commission meeting. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miand Page 1 of 2 File Id. 10-00181 (Version: 1) Printed On: 7/18/2017 File Number: 10-00181 Enactment Number: R-10-0091 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
