PELHAM Secretary On December 1, 2009, the Department of Community Affairs sent a letter regarding City of Miami Amendment Number 10-1, which proposed the creation a regional activity center under the Development of Regional Impact program. In that letter, the Department stated that since the City was designated a dense urban land area (DULA) under Senate Bill 360 and was no longer subject to the Development of Regional Impact program, the City was ineligible to adopt such a designation. Upon further review, the Department notes that Senate Bill 360 amended Section 380.06(29)(f), Florida Statutes (F.S.), to require local governments to send development orders to the Department for projects that would be larger than 120% of the applicable DRI threshold. Thus, a local government that is a DULA and is exempt from the DRI program can nonetheless seek the RAC designation in order to increase the applicable threshold that will trigger the reporting requirement in Section 380.06(29)(f), F.S. Therefore, the Department agrees the City can amend its comprehensive plan to create this designation.
