Legislation www.miamigov.com Resolution File Number: 10-00128 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT TWO TO THE FISCAL YEAR 2005 COMMUNITY DEVELOPMENT BLOCK GRANT DRI CONTRACT BETWEEN MIAMI- DADE COUNTY AND THE CITY OF MIAMI, IN SUBSTANTIALLY THE ATTACHED FORM, TO EXTEND THE CONTRACT FROM DECEMBER 31, 2009 TO JUNE 30, 2010, FOR THE PURPOSE OF PROVIDING COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS, IN THE AMOUNT OF $2,000,000, FOR THE REHABILITATION OF MULTI -FAMILY PROPERTIES THAT SUFFERED HURRICANE DAMAGE UNDER THE MILITARY CONSTRUCTION APPROPRIATIONS AND EMERGENCY HURRICANE SUPPLEMENTAL APPROPRIATIONS ACT, A/K/A DISASTER RECOVERY PROGRAM, FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. WHEREAS, pursuant to the Military Construction Appropriations and Emergency Hurricane Supplemental Appropriations Act, Community Development Block Grant ("CDBG") disaster relief funding was made available to the State by the United States Department of Housing and Urban Development ("U.S. HUD"); and WHEREAS, Miami -Dade County ("County") was allocated the amount of $16,000,000, to be shared by all municipalities in the County based on need and the project; and WHEREAS, pursuant to Resolution No. 07-0131, adopted March 8, 2007, the Miami City Commission gave the City Manager the authority to accept CDBG funds in the amount of $2,000,000, from the County for the Disaster Recovery Program; and WHEREAS, said funds were to be utilized to provide rehabilitation assistance to ten multi -family properties that were damaged due to the hurricanes; and WHEREAS, on September 11, 2007, a contract between the City of Miami ("City") and the County was executed for the purpose of providing CDBG funds for the rehabilitation of the multifamily properties with an expiration date of June 30, 2008; and WHEREAS, pursuant to Resolution No. 09-0216, adopted May 14, 2009, the Miami City Commission approved the extension of the $2,000,000 CDBG contract between the County and the __.C.ity_for_the_D is asterRecovery_Program.from June- 30, 2008 to_.December_31, 2009; and __ _ WHEREAS, the Administration recommends the approval of the extension of the contract between the County and the City for the Disaster Recovery Program from December 31, 2009 to June 30, 2010, and authorizes the City Manager to execute an amendment of the contract for the extension of the $2,000,000 CDBG contract; City of Miami Page I of 2 Fite Id: 10-00128 (Version: 1) Printed On: 2/9/2010 File Number. 10-00128 NOW, THEREFORE, BE 1T RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1 } to execute Amendment Two to the Fiscal Year 2005 CDBG DRI contract, between the City and the County, in substantially the attached form, to extend the contract from December 31, 2009 to June 30, 2010, for the purpose of providing CDBG funds in the amount of $2,000,000, for the rehabilitation of multi -family properties that suffered hurricane damage under the Military Construction Appropriations and Emergency Hurricane Supplemental Act, a/k/a Disaster Recovery Program, from the U.S. HUD. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS4i" JULIE O. BR CITY ATTORNLY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
