HomeMy WebLinkAboutLegislation-¢f City of Miami Legislation Resolution File Number: 10-00104 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT RIGHT-OF-WAY DEEDS, IN SUBSTANTIALLY THE ATTACHED FORM(S), FOR THE EXPANSION OF NORTHWEST 9TH STREET, BETWEEN NORTH MIAMI AVENUE AND NORTHWEST 1ST AVENUE, MIAMI, FLORIDA, FROM PARK PLACE ASSOCIATES, LLC, BAYVIEW TOWERS ASSOCIATES, LLC AND MADISON DOWNTOWN CONDOMINIUM ASSOCIATION, INC; APPROVING AND AUTHORIZING THE RECORDATION OF SAID RIGHT-OF-WAY DEEDS IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; AUTHORIZING THE CITY MANAGER TO DIRECT THE CITY ADMINISTRATION TO AMEND THE CITY OF MIAMI MUNICIPAL ATLAS TO DESIGNATE THE PROPERTIES IDENTIFIED IN SAID RIGHT-OF-WAY DEEDS, AS OFFICIAL PUBLIC ROADWAY; FURTHER AUTHORIZING THE CITY MANAGER TO DIRECT THE CITY ADMINISTRATION TO NOTIFY THE MIAMI-DADE COUNTY PROPERTY APPRAISER OF THE CHANGE IN STATUS AND OWNERSHIP OF THE PROPERTY IDENTIFIED IN SAID RIGHT-OF-WAY DEEDS. WHEREAS, Park Place Associates, LLC, Bayview Towers Associates, LLC and Madison Downtown Condominium Association, Inc., the owners of land at 915 Northwest 1st Avenue and 800 North Miami Avenue, Miami, Florida, have offered to dedicate land as public right-of-way to accomplish the expansion of Northwest 9th Street between North Miami Avenue and Northwest 1 st Avenue, Miami, Florida; and WHEREAS, the expansion of Northwest 9th Street, Miami, Florida, at this location is consistent with the Northwest 9th Street Mall concept contained within the Southeast Overtown/Park West Redevelopment Plan; and WHEREAS, the City Commission finds it in the best interest of the City to accept right-of-way deeds for said properties; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept the Right -of -Way Deeds, in substantially the attached form(s), for the expansion of Northwest 9th Street between North Miami Avenue and Northwest 1st Avenue, Miami, Florida, from Park Place Associates, LLC, Bayview Towers Associates, LLC and Madison Downtown Condominium Association, Inc. Section 3. The recordation of the herein said Right -of -Way Deeds in the Public Records of City of Miami Page 1 of 2 Printed On: 1/27/2010 File Number.' 10-00104 Miami -Dade County, Florida, is approved and authorized. Section 4. The City Manager is authorized{1} to direct the City Administration to amend the City Municipal Atlas to designate the properties identified in said Right -of -Way Deeds as official public roadway. Section 5. The City Manager is further authorized{1} to direct the City Administration to notify the Miami -Dade Property Appraiser of the change in status and ownership of the property identified in said Right -of -Way Deeds. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
