HomeMy WebLinkAboutR-10-0053Vop City of Miami ' Legislation < U R �O Resolution: R-10-0053 File Number: 10-00103 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/11/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND GOLDEN SANDS ALLAPATTAH CORPORATION, INC., FOR THE USE OF APPROXIMATELY 9,000 SQUARE FEET OF PROPERTY IN MIAMI, FLORIDA, FOR THE PURPOSE OF PROVIDING OFFICE SPACE FOR THE INTERNAL AFFAIRS DIVISION OF THE MIAMI POLICE DEPARTMENT, WITH A MONTHLY RENT OF $11,437.50 ($15.25 PER SQUARE FOOT), FOR THE PERIOD OF ONE (1) YEAR AND A $15.00 CHARGE PER HOUR, FOR OVERTIME AIR CONDITIONING USAGE, WITH TERMS AND CONDITIONS AS MORE SPECIFICALLY SET FORTH IN SAID LEASE; ALLOCATING FUNDS FROM THE MIAMI POLICE DEPARTMENT'S BUDGET. WHEREAS, pursuant to Resolution No. 02-900, adopted July 25, 2002, the City Commission authorized the City Manager to enter into a Lease Agreement (the "Lease") with Golden Sands Allapattah Corporation (the "Lessor"), for the use of 9,000 square feet of office space in Miami, Florida (the "Premises"), at a monthly rate of $14.50 per square foot; and WHEREAS, pursuant to Resolution No. 04-0056, adopted February 12, 2004, the City Commission authorized the City Manager to execute Amendment No. 1 to the Lease, with the Lessor, extending the term of the Lease for a one (1) year period at a rate of $14.50 per square foot with the option to renew the Lease for four successive one (1) year terms, each with further annual increases calculated based upon increases in the Consumer Price Index, but not to exceed a maximum annual increase of three percent for use of the Premises; and WHEREAS, the Lease has expired and the Internal Affairs Division of the Miami Police Department needs office space and wishes to pursue a new Lease with the Lessor; and WHEREAS, the City of Miami ("City") and the Lessor wish to enter into this Lease for the period of one (1) year, with the option to renew for two (2) successive terms of one (1) year each, subject to the rent increases provided for in Section 3 of the Lease; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute a Lease Agreement, in substantially the attached form, between the City and the Lessor, for the use of the Premises, for the purpose of City of Miand Page 1 of 2 File Id. 10-00103 (Version: 1) Printed On: 7/14/2017 File Number: 10-00103 EnactmentNnmber: R-10-0053 providing office space for the Internal Affairs Division of the Miami Police Department, with a monthly rent of $11,437.50 ($15.25 per square foot), for the period of one (1) year and a $15.00 charge per hour, for overtime air conditioning usage, with funds allocated from the Miami Police Department's budget. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
