HomeMy WebLinkAboutLegislationFile Number: 10-00110 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, GRANTING AN INCREASED NUMBER OF CLASS I SPECIAL PERMITS (BEYOND THE TWO (2) SPECIAL EVENTS ALLOWED PER YEAR), FOR THE FUNDRAISER EVENTS FOR THE RICKIA ISAAC FOUNDATION/INDIGO, LOCATED AT 613 NORTHWEST 72 STREET, MIAMI, FLORIDA; SPECIFICALLY TO ALLOW A SERIES OF FUNDRAISING EVENTS TO BE ACCOMMODATED AT THE SITE FOR A PERIOD OF FIVE (5) MONTHS COMMENCING ON JANUARY 15,2010 THROUGH MAY 15, 2010, WITH CONDITIONS AS STATED HEREIN. WHEREAS, the applicable provisions of Section 906.9 of the Zoning Ordinance of the City of Miami, Florida, as amended ("Zoning Code"), provide, in part, that (unless approved by a four-fifths (4/5ths) affirmative vote of the City Commission waiving this requirement) no more than a total of two (2) temporary events on private property per year, per site, may occur and further that the City Commission may approve not more than a total of four (4) temporary events per site on private property per year, by a four-fifths (4/5ths) vote or a single event for a duration of more than two (2) weeks; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, an increased number of Class I Special Permits (beyond the two (2) special events allowed per year), is granted for a series of fundraising events for the Rickia Issac Foundation/Indigo, located at 613 Northwest 72 Street, Miami, Florida, specifically to allow fundraising events to be accommodated at the site for a period of five (5) months, commencing on January 15, 2010 through May 15, 2010; with such Class I being subject to review and approval by the Zoning Administrator as set forth in Articles 13 and 14 of the Zoning Code. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS' JULIE O.
