HomeMy WebLinkAboutAnalysisPLANNING DEPARTMENT ANALYSIS Case No. 2009-00030ec CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE AN EASEMENT LOCATED EAST OF NORTHWEST 2nd AVENUE FROM NORTHWEST 3" STREET TO NORTHWEST 4" STREET. Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has reviewed the proposed easement vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way. The following findings have been made: It is found that this application was presented to the Plat and Street Committee and the tentative Plat was approved with conditions. It is found that the vacation and closure of the easement will unified the site and allow the construction of a new government facility (Miami -Dade County Children Courthouse). • It is found that the proposed easement vacation complies with Section 55-15 (c) of the Miami City Code for public benefit since the proposal will not affect the core service activities and will allow the construction of a new government facility. Based on these findings, the Planning Department recommends approval of the request.
