ON METRO APARTMENTS.

Pursuant to Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami,
Florida, Supplement 16, the subject proposal has been submitted and reviewed for the
City Commission to allow the partial release of the Declaration of Restrictive Covenant
and the approval of a proposed project on the property.
The subject property consists of several lots fronting NW 1St Avenue, (a complete
legal description on file at the Hearing Boards Office),
The following findings have been made:
• It is found that on September 28, 2006 was approved on Second Reading a request to
change the zoning classification on the subject properties that include a Covenant
with the condition that any new construction that is proposed for development of the
properties included on Exhibit A will be reviewed to obtain approval from the Miami
City Commission at a public hearing as well as the necessary approvals required by
zoning regulations.
• It is found that on June 8t", 2009, the Class II Special Permit No. 09-0107 was
approved with conditions for a proposed development on a portion of the subject
properties.
• It is found that on October 71h, 2009, the applicant presented plans for approval by
City Commission as required by the covenant on the properties.
Based on these findings, and on the Analysis as part of the Class II Special Permit,
the Planning Department is recommending Approval of the application with the fol-
lowing conditions:
L -The applicant should comply with conditions specify at the Final Decision of the
Class II Special Permit No. 09-0107 dated June 8th, 2009.
2.- Any modifications to the plans presented as part of the Class II Special Permit
No. 09-0107should have the approval of the Planning Department.
3. -Any project for development on the rest of the properties not included on this
proposal will require a review by the Planning department and the approval by the
City Commission
