Thompson _City Clerk Executive SumMpnf EDC Corporation was authorized by residents of Rockerman Road and the Rockerman Road Homeowners Association Inc., (the "Client"), to prepare an environmental report of the Rockerman Canal, (the "Canal"), to assess conditions and summarize findings that itemize existing environmental conditions and to recommend remedies, that improve water quality, the ecological health and the navigational conditions of the Canal and stabilize the shoreline on the Kennedy Park bank of the Canal to prevent further deterioration of the Canal's current condition. Based upon the observations detailed in the body of this report, the Rockerman Canal has experienced long term morphological and environmental changes that have reduced tidal exchange, caused erosional bank deposition into the Canal, and introduced wetland vegetation that has encroached into the Canal's channel fairway, significantly reducing navigation ingress and egress for residents to the Canal, affecting their quality of life and property values. The current conditions of the Canal can be summarized as follows: 1. Boats can no longer navigate the Canal safely. 2. Fish and wildlife that previously inhabited the Canal has disappeared. 3. The Canal's right of way, (the channel fairway), has been significantly reduced by uncontrolled sedimentation and the uncontrolled growth of native and exotic vegetation reducing navigational movement in the Canal. 4. Storm water run-off has deposited silt on the un -stabilized shoreline on the Kennedy Park bank of the Canal, has accreted into the Canal right of way and has reduced navigable depths in the upper reaches of the Canal basin to 18 inches or less at mean low.water seriously reducing the Canal's navigability and ecological viability. 5. Storm water run-off at the un -stabilized Kennedy Park bank shoreline continues to regularly deposit sediment into the Canal during rainfall and tropical cyclone events increasing the poor environmental conditions of the Canal. The Canal's deteriorated condition has been caused by the lack of stabilization of the shoreline and the lack of trimming and maintenance of the vegetation growing uncontrollably on the Kennedy Park bank of the Canal. It is EDC's professional opinion that environmental restoration of the Rockerman Canal is warranted as soon as possible so permanent damage to the Canal's navigability_ and ecosystem can be avoided. Restoration can be achieved by: (1) removing the sediment accumulated in the Canal. Thompson - - — - City Clerk - • (2) removing and relocating the vegetation that, due to uncontrolled growth, has encroached into the Canal right of way. (3) arresting accretion of the bank of the Canal by stabilizing the shoreline with the installation of rip -rap and a berm. (4) arresting the uncontrolled growth of exotic non-native species and mangrove vegetation by removing and relocating the encroaching vegetation in a manner that curtails future uncontrolled growth and by regular landscape maintenance of vegetation growing within close proximity to the Canal bank. (5) arresting storm water run-off that carries sediment into the Canal bottom and accumulates in the bank of the Canal by the installation of rip rap and by the making of a berm to prevent further silting from storm water run-off into'the Canal. It is recommended that the berm be made from the sediment that is removed from the Canal. The cost of restoration can be achieved at an estimated cost of $422,000, as detailed in this report. Shoreline stabilization along the Kennedy Park side of the Canal, after removal of the sediment currently deposited in the Canal and the removal and relocation of vegetation encroaching into. the Canal right of way, will limit erosion and silting into the Canal and Biscayne Bay in the future. Public funding sources are available for dredging and shoreline • stabilization to correct the current conditions and to implement reasonable measures that will prevent the current conditions from recurring in the future. • The restoration measures outlined can greatly improve water quality in the Canal. Improved water quality will lure fish and wildlife back to the Canal restoring the ecological health �of the Canal. Vessels will be able to navigate the full length of the Canal safely and free of hazards. Navigability and ecological health will restore property values of the residential side of the Canal. Finally, stabilization of the Park bank of the Canal will prevent future encroachment into the Canal right of way protecting further deterioration from occurring in the future. April 2008 3 - EDC CORPORATION 1® Authorization EDC Corporation was retained by several Rockerman Road Homeowners and the Rockerman Road Homeowners Association Inc., (the "Client"), to (1) assess the current condition of the Rockerman Canal with particular emphasis on the Canal's navigability and ecological health; (2) assess the causes of the Canal's current deteriorated condition, poor navigability and ecological health; (3) assess the steps needed to correct the Canal's current conditions and to restore the Canal to its historically usable, navigable and ecologically healthy condition; (4) identify the permits required to do the work needed to restore the Canal to its historically usable, navigable and ecologically healthy condition; (5) quantify the cost of the measures required to restore the Canal to its historically usable, navigable and ecologically healthy condition. The Client contacted EDC in 2007 and requested assistance to prepare an environmental • condition report to address concerns that the Canal has been subject to multiple- coastal and environmental processes that have negatively affected the water quality and ecological health of the Canal system by the lack of shoreline stabilization on the bank of the Canal's Kennedy Park shoreline resulting in: (1) boats no longer being able to navigate the Canal safely; (2) fish and wildlife that previously inhabited the Canal disappearing from the Canal; (3) the Canal's right of way, (the channel fairway), being significantly reduced by uncontrolled sedimentation and the uncontrolled growth of native and exotic vegetation, reducing navigation movement in the Canal; (4) storm water run-off eroding the unstabilized Kennedy Park shoreline reducing navigable depths in the upper reaches of the Canal basin to less than 18 inches at mean low water; Submitted into the public April 2008; record in connection with 4 - EDC CORPORATION item PH.11 on 01-28-10 Priscilla A. Thompson City Clerk • (5) sediment and silt carried by storm water run-off flowing to the unstabilized Kennedy Park shoreline continuously and regularly depositing sediment into the Canal during rainfall and tropical cyclone events. The Rockerman Canal is part of the Rockerman Heights Subdivision. Located in Coconut Grove, (See Figure 1). The Canal is 27 feet wide and 870 feet long and runs north east to south west. It is bounded on the southwest end by two homes on South Bayshore Drive and on the north east endby Biscayne Bay. The Canal was created to serve as a navigational waterway for the residential properties on Rockerman Road. One bank abuts residential homes on Rockerman Road. The other bank of the Canal abuts Kennedy Park, (See Figure 1 A).. Rockerman Heights was developed during the early 1950s by Rockerman Builders Inc. a company headed by George Rockerman. The subdivision, which is recorded in Plat Book 53, at Page 57 of the public records of Miami -Dade County, Florida, was 'platted by Phillip 'Morris and'Fannie Morris by Plat dated August 18, 1952. (See Figure 2). On January 15, 1953, after having platted the subdivision, Phillip and Fannie Morris conveyed title to the 29 buildable lots in Block 1 and Block 2 of the Rockerman Heights Subdivision to Rockerman Builders Inc. Tracts B and C of the Subdivision were conveyed by Phillip and Fannie Morris to the City of Miami in 1952. Tract B of the Plat is two feet wide and borders the Plat of Rockerman Heights on the Northeast side of Rockerman Road from South Bayshore Drive to Biscayne Bay. This appears to be part of Rockerman Road. Tract C of the Plat is also two' feet wide and runs on the South West Side of the Plat adjacent to the Rockerman Canal and is part of the property known as Kennedy Park, owned by the City of Miami. Tract C runs along the Canal from South Bayshore Drive to Biscayne Bay. George Rockerman and his company, Rockerman Builders Inc. developed the subdivision platted by Phillip and Fannie Morris by, amongst other things, dredging the Rockerman Canal, (See Figure 3), to a depth of approximately ten (10) feet at the bay end of the Canal to approximately six (6) feet at the Cove, (the South Bayshore Drive end), of the Canal. =y Submitted into the public April 2008 record In connection with .5- EDC CORPORATION item PH.11 on 01-28-10 Priscilla A. 'Thompson City Clerk • Rockerman Builders Inc. built homes on the lots purchased from Phillip and Fannie Morris and sold them to different buyers over the course of several years. As part of the development process the shoreline of all the lots bordering the Canal was stabilized by the construction of a concrete seawall. The City of Miami stabilized the Kennedy Park shoreline bordering Biscayne Bay in 1995, (See Figures 4 and 5), but left the shoreline bordering the Rockerman Canal untouched. The South.West Side of the Canal along the Kennedy Park shoreline, owned by the City of Miami, has never been stabilized and has been left unmaintained by the municipality to endure the natural effects of the elements. The period from the mid 1960's to 1992 was a relatively quiet time meteorologically with only a few tropical storms passing thru the South Florida area. On August 24, 1992 Hurricane Andrew passed through South Florida and Coconut Grove :destroying most of the vegetation in the area. Most of the vegetation in Kennedy Park, including the Kennedy Park bank of the Canal was swept away by Hurricane Andrew making • the Kennedy Park side of the Canal and its bank barren, (See Figures 5-11). As of the date of this report the shoreline of the Kennedy Park side of the Canal remains an un -stabilized shoreline colonized by a mixture of wetland and exotic species of vegetation. Photos taken from similar vantage points as the photos in Figures 6-11, (taken immediately after the passage of Hurricane Andrew) are shown in Figures 12-17. The figures pre -aligned for comparison according to the vantage point from which they were taken. According to on=line public records kept by the Secretary of State of the State of Florida, Rockerman Builders Inc. was dissolved by proclamation June 28, 1965, twelve years after purchasing the lots in Block 1 and Block 2 from Phillip and Fannie Morris, (See Figure 18). According to on-line public records kept by Miami -Dade County, Florida, First Florida Savings Bank, a subsidiary of Wachovia Bank, N.A, owns the Rockerman Canal parcel, of the Rockerman Heights Subdivision, (See Figure 19). There is no on-line record kept by Miami - Dade County reflecting the date that First Florida Savings Bank became the owner of the Rockerman Canal. Thompson City Clerk r1 U • • According to those same online records First Florida Savings Bank has not paid real estate property taxes on the Rockerman Canal parcel since 1986, a total of 21 years. Based on those records only, it is assumed that First Florida Savings Bank has owned the Rockerman Canal for at least 21 years or since 1986, (See Figure 20). There are no records showing that maintenance dredging has ever been done to the Rockerman Canal. 3. Field Investigations EDC mobilized a crew of engineers and surveyors to perform a hydrographic and location survey of the Rockerman Canal from the upper basin, (the Bayshore Drive end), to the mouth at Biscayne Bay in September 2007. Measurements were taken using a survey grade total station instrument that is accurate to one (1) centimeter or better in x, y, and z dimensions. The approximate seaward location of the exotic and mangrove vegetation.canopy along the Kennedy Park Canal bank were also located during the survey. City of Miami survey control bench marks (adjusted to NGVD 1929 datum) were found and tied to the instrument so that recorded depths were recorded in NGVD elevations. Tide staffs were set to relate recorded data to Mean Low Water (MLW) datum. A hydrographic survey was prepared reflecting depths at different points of the Canal, the boundaries of the Plat of Rockerman Heights and the vegetation that has encroached into the legal limits of the Canal right of way. A copy of the Survey is attached to this report as Exhibit „A„ Random probes were made within the Canal bottom but were taken more frequently at the Bayshore Drive end where shoaling was found to be more pronounced. Observations show the Canal, at the Bayshore Drive end, to contain more than 3 feet of silt overburden. A FDEP formal benthic survey was not performed but visual observations show the Canal to be a barren substrate. Soil samples were not taken and analyzed for contaminants but a sample taken in 1993 by the Client, (the 1993 Sediment Test), showed no contaminants to exist in the sediment collected in the Canal at the time the test was made. No visible evidence showing that the Canal sediment is contaminated was observed. A copy of the 1993 Sediment Test showing no contamination in the sediment is attached to this report as Exhibit "B". Submitted into the public record in connection with item PH.11 on 01-28-10 Priscilla A.1'hompson City Clerk /- °I April 2008 , .7- EDC CORPORATION • • a According to the best available aerial and legal records, the Rockerman" Canal is an artificially dredged water body, created in the early 1950's. Except for bulkheading on the residential bank, the Rockerman Canal has remained unaltered and un -maintained since its creation. Based on conversations with long time residents living on the residential side of the Canal, the Canal's condition has slowly deteriorated over the years due to the Canal's loss of depth from silting, the loss of width from the uncontrolled growth and encroachment of vegetation and the accretion of the Canal bank into the Canal right of way. Current Conditions: Analysis of the field data, historical aerials, and conversations with residents along the Canal supports the observations that gradual and continued morphological changes are affecting the Rockerman Canal. Field data indicates the Canal has been affected in different ways along its 870 -foot length. Water depth and width from Biscayne Bay to a distance about halfway into the Canal are currently adequate for navigation and movement of boat traffic. The Kennedy Park shoreline of the Canal in this area is suffering from continual erosion from storm water run-off and the uncontrolled growth of vegetation, though up to this point in time the erosion and uncontrolled vegetation growth has not affected navigation. In the future, if left unattended, navigation and access in this part of the canal will be negatively affected. Depths from approximately halfway into the Canal to the Bayshore Drive end of the Canal, (the Inner Half of the Canal), and the Canal cove currently are as low as eighteen inches (1.5 feet) at Mean Low Water when historically the depth at Mean Low Water was -5 feet, making navigation on the Inner Half of the Canal hazardous and unsafe, (See Figures 21, 22 and 23). Uncontrolled expansion of exotic non native species and mangrove vegetation canopy in the Inner Half of the Canal on the Kennedy Park shoreline has in some areas extended itself as much as .15 feet into the legally defined Canal right of way. Thompson City Clerk i 8- • effect created by the vegetation has reduced the channel fairway to only 18 feet wide when the right of way width should be 37 feet, making navigation and boat traffic difficult and unsafe, (See Figures 24-29). Fish and wildlife throughout the entire length of the Canal are no longer plentiful, mostly due to the shallowness of the Canal. Causes of Current Canal Conditions: Current coastal and environmental conditions have combined in differing degrees to cause alterations to Rockerman Canal's historically usable, navigable and ecologically healthy condition. It is EDC's opinion that the Canal's current deteriorated condition has been caused by the lack of shoreline stabilization ..and the lack of trimming and maintenance of the vegetation growing uncontrollably on the shore of the Kennedy Park side of the Canal. Kennedy Park is a municipal public park managed and maintained by the City of Miami Parks • and Recreation Department. The Park can be divided in twa sections. One of the two sections, (the North East Section), abuts the Rockerman Canal and is where the Park land abuts the Canal. The North East Section of the Park slopes down into the bank of the Canal, (See Figures 30 and 31). As a result of the sloping land storm water runs off and flows uncontrolled from the Park into the Canal. The run-off of storm water naturally carries sediment from the Park into the -Canal. The un -stabilized shoreline on the Kennedy Park side of the Rockerman Canal coupled with long term storm water running off and flowing into the Canal, carrying silt and sediment into the Rockerman Canal has caused the Canal to become filled with silt at the Bayshore end, to the point that the depth of the Canal has been reduced from five (5) feet to one and one half (1'/z) feet, (See Exhibit "C"). As a result, the Canal's ecological health has deteriorated and vessels cannot navigate safely. The sedimentation process, without stabilization, has also allowed silt and sediment to settle on the Canal shoreline creating a process on the shoreline whereby the shoreline has accreted. As the shoreline has accreted, vegetation has grown and propaged, solidifying the Submitted into the public April 2008 .9- EDC CORPORATION 11 record in connection with item PH.11 on 01-28-10 Priscilla A. Thompson City Clerk J • ground around it. The accretion of the shoreline has steadily crept into the legally defined Canal right of way and encroached as many as 15 feet in some areas. The uncontrolled growth of exotic non-native species and mangrove vegetation on the accreted ground has further encroached into the Canal right of way causing bottlenecks at several points of the Canal that affect navigation and make boat traffic hazardous and unsafe. This is particularly evident in the upper reach, (Bayshore Drive end), of the Canal. Data indicates that the vegetation growth and canopy infringes on and overhangs the Canal right of way up to 15 feet in some areas, (See Exhibit "D"). Given that the City of Miami has never stabilized the shoreline on the Kennedy Park side of the Canal and does not maintain or keep vegetation on the shoreline from uncontrollably growing into the Canal, the conditions of the Canal will continue to deteriorate if no corrective action is taken. It should be noted that the Client and the City of Miami Parks and Recreation Department staff have met on several occasions where the Client has requested the City Parks and Recreation Department to trim the mangroves in accordance with the DERM mangrove trimming permit currently in place and to stabilize the Canal's Kennedy Park shoreline to prevent further deterioration of the Canal. The City has not taken any action to trim the existing vegetation or is curtail the uncontrolled encroachment of silt into the Canal right of way. 5e Actions Required t® Correct Current Conditions of Rockerman Canal Several measures are necessary to restore the water quality, ecological health and navigation access of the Canal to its historically usable, navigable and ecologically healthy condition. Trimming of Exotic Non Native Species and Mangrove Vegetation: Field data obtained by EDC and superimposed on the historical Rockerman Road survey clearly shows that exotic non-native species and mangrove growth on the Park shoreline has encroached into the Rockerman Canal channel limits as a result of uncontrolled growth. The first recommended measure to restore the Canal is to trim the overgrown canopy of exotic Submitted into the public record in connection with item PH.11 on 01-28-10 Priscilla A. Thompson City Clerk April 2008 .10- EDC CORPORATION `� F • non-native species and mangrove vegetation intruding into the Canal right of way. In the case of exotic non-native vegetation trimming, should be done to no less than five (5) feet into the Park property line to allow managed maintenance and curtailment of future growth. An existing mangrove trimming permit issued by the Miami -Dade County Department of Environmental Resource Management, (DERM), to the City of Miami allows for the trimming of mangroves on the Kennedy Park side of the Canal shoreline, (See Exhibit "E"). In the case of mangroves trimming should be done up to the point that the existing mangrove trimming permit issued by DERM allows. Maintenance Dredging of the Rockerman Canal: Results of the hydrographic survey show the upper reaches of the Canal have shoaled considerably reaching a depth of only 18 inches NILW in the basin. Maintenance dredging is recommended for the Canal from existing depths to (-) 5.0 feet MLW north to include the upper cove. The middle and lower reaches towards the Bay seem to show adequate depths for • mooring and navigation and no dredging work is proposed in these areas. The area of the Canal that requires dredging is shown on Figure 32. Maintenance dredging will restore the historical depths of the Canal to (-) 5 ft. MLW in the upper reaches of the Canal. Maintenance dredging of the Rockerman Canal presents challenges in mechanical operation, maneuverability in close confines, spoil containment and transportation. Hydraulic dredging is the most desirable method for carrying out the maintenance dredging operation in that it only requires a small suction pump, pipeline and a small float barge to house the equipment. This method will generate little disruption to the residents of Rockerman Road and to Kennedy Park, but is predicated on locating a suitably sized disposal site. Hydraulic dredging creates a large liquid sediment mixture that must be deposited close by within a large contained area to allow for drying before disposal. The only nearby source of land where this type of operation could be done is Kennedy Park. It is suggested that the ideal situation would be for the silt, which originated from Kennedy Park, would be returned to Kennedy Park. This option is also desirable in that there would be no cost for disposal of the silt material, which is one of the largest cost items in the maintenance dredging operation suggested. Cooperation and authorization from the City of Miami is necessary for this option to be made viable. Thompson City Clerk J • • Relocation and/or Removal of Exotic Non -Native Species and Mangrove Vegetation from the Rockerman Canal Right of Way; Field data obtained by EDC superimposed on the historical Rockerman Road survey, (Exhibit A of this Report), clearly shows that vegetation growth of exotic non native species and mangrove have encroached significantly into the Rockerman Canal right of way.. This is particularly evident in the upper reaches, (the Bayshore Drive end), of the Canal. In addition to growth encroachment, data indicates a canopy overhang into the Canal of up to 15 feet in some places, (See Exhibit "D") Remediation entails removal of the exotic non-native species of vegetation and mangrove trees and plants, some larger than others all with the potential of continued over growth into the Canal fairway. In a few instances 15 to 20 foot high trees must be removed to restore the channel to its original dimensions. The area where removal and relocation of vegetation is recommended is shown. in Figure 33. Shoreline Stabilization: Investigations by EDC have concluded that the unstabilized shoreline along Kennedy Park has been the main contributor to the morphological changes over time resulting in shoaling and diminished navigation in the Rockerman Canal. EDC has determined that stabilizing the shoreline will mitigate further degradation of the Canal. Stabilization can be accomplished by the use of rip -rap, by berming the shoreline or by a combination of both. It is EDC's opinion that shoreline stabilization using riprap in some areas of the Kennedy Park bank of the Rockerman Canal together with a berm, in other areas of the Canal's bank would be effective in preventing further erosional processes from occurring' in the future. This method would also be more effective from the cost point of view. The areas where rip rap and a berm should be installed is shown in Figure 34. Cost Estimates of Work Required to Restore Trimming of Exotic Non- Native Species and Mangrove Vegetation: Trimming of the vegetation currently encroaching into the Canal right of way can be done by using the mangrove trimming permit at an estimated cost of $4,500. Hydraulic Maintenance Dredging: Hydraulic maintenance dredging will restore the historical depths of the Canal to (-) 5 ft. MLW in the upper reaches of the Canal and, as previously mentioned, is the most desirable method for carrying out the maintenance dredging operation. Based on the hydrographic survey it is estimated that up to 1,000 cubic yards of material will be removed from the Canal. EDC has contacted several Marine Contractors and they have indicated that costs for this type of work could be on the order of $110/cubic yard (cy) provided the material is classified by DERM as non -contaminated. Using this estimate and assuming that the material to be removed is not contaminated, maintenance dredging costs will be approximately $110,000. An alternative would be to discharge the sediment into watertight containers and transport a liquid -solid mix directly to the landfill. Landfill costs are based on weight, so this can be an expensive alternative given the weight of a liquid -solid material. The selected Contractor could construct a small segmented barge that can be positioned in the Canal with a barge mounted small backhoe and container that will allow operation in close quarters. The containers would be vented to release water back into the Canal (with turbidity curtains in place downstream). Containers could then be offloaded to flat bed trucks for transport to the landfill. Thompson City Clerk • C, 0 Relocation and/or Removal of Exotic Non -Native Species and Mangrove Vegetation from the Rockerman Canal Right of Way: For the purposes of this report EDC estimates up to 10,000 square feet of mangrove trimming/removal is the minimum necessary to restore navigation ingress/egress to residents of the Canal. The cost for this work is twofold. First there is the cost to perform the work itself, which is estimated at $4/sf per DERM guidelines. That would amount to approximately $40,000. The cost of removal of exotic non-native species is estimated at $10,000. Second there are mitigation costs for the removal of mangroves that start at a ratio of 2:1 but can be ashigh as 4:1 plus acquisition of a site and actual construction of a mitigation project. Accordingly, mangrove mitigation can range up to $160,000, depending on the final scope of work. Stabilization of the Kennedy Park Bank of the Rockerman Canal: Rip rap costs to stabilize the bank of the Kennedy Park side of the Rockerman Canal are estimated to be on the order of $100 per foot. Not all of the Canal's shoreline along Kennedy Park may have to be rip rapped if the material removed from the Canal is used to build a berm in some areas of the Parkland that will prevent run-off into the Canal and contain further erosion. Assuming 600 feet of the Canal's 861 feet are rip rapped the cost of the rip rap would be $60,000. 7. Permits Required and Costs of Permits The Client and the titleholder of the Rockerman Canal are fully disposed and willing to cooperate in securing any permits required to perform the Canal's remediation. Permits for Trimming Overgrown Vegetation: A permit for trimming mangroves is currently in place and can be used for trimming mangrove vegetation on the Kennedy Park shoreline of the Rockerman Canal. A permit from the City of Miami may have to be obtained to trim exotic non-native species of vegetation on the Kennedy Park shoreline of the Rockerman Canal. Further inquiry into the requirements of a permit to trim the exotic non-native vegetation needs to be made since most of the vegetation is located within property owned by the City of Miami. Cost of preparing the application is $250. The permit fee charge by the governmental authority is $250. Permits for Maintenance Dredging: EDC has made contact with the regulatory agencies about this work. Permits will be required from the State of Florida DEP, U.S_ Army Corps of Engineers (ACOE), and Metropolitan Dade County DERM. If the applicant can demonstrate the Canal is man made and was dredged to a set depth, the DEP and ACOE can issue an exemption and a Nationwide General permit respectively. DERM will issue a Class I Coastal Permit. The DEP and ACOE permits should be issued within 4-6 months. DERM is likely to take somewhat longer. DERM will require a Spoil Containment and Disposal Plan, sediment samples analyzed for contaminants, letters of approval to dispose to an approved landfill (if the material is not utilized to create a beneficial berm in Kennedy Park), as well as permit fees and bonds. Obtaining maintenance dredging approvals appears possible and can be obtained within 6 to 8 months from the submittal of an application. Cost of preparing the application is $5,000: The permit fee charge by the governmental authority is $1,000. Permits for removal and relocation of Exotic Non -Native Species and Mangrove Vegetation: Permits from all three previously mentioned regulatory agencies will be required for this work. EDC and the Client have met with DERM to present their case. DERM has expressed a willingness to review the application and has stated that maintenance of a navigable channel is a criterion whereby DERM may issue a permit. Other agencies will review and comment on the application and will mostly follow the recommendations presented by DERM as part of their decision process. Cost of preparing the application is $5,000. DERM may issue an exemption but most likely will require a Class I permit plus mitigation bonds if any work involves the possibility of impact to mangroves. Cost of preparing the application is $5,000. The permit fee charge by the governmental authority is $1,000. 8 Funding Sources Permits, other than the trimming permit currently in place, must be obtained in order to do the remediation work that will restore the Rockerman Canal to its historically useful condition. Permits can be obtained relatively quickly and once permits are issued there are a number of funding sources that can be approached to mitigate the cost of the work provided the City of Miami cooperates given that any request for public funding and grant requests must come from the municipality. Permits for shoreline stabilization are fairly easy to acquire and there are public funds available to pay for most if not all of this work. The City of Miami, on behalf of the affected residents should pursue these funding opportunities and establish a program for implementing a shoreline stabilization project. The sources of funding water related maintenance projects must be accessed by local governmental agencies such as Miami -Dade County of the City of Miami. While mangrove trimming/removal may not be covered for this type of funding, dredging and shoreline stabilization, as that needed `to correct the current conditions of the Rockerman Canal, are usually eligible for funding by the Florida Inland Navigation District (FIND) or the South Florida Water Management District (SFWMD). Disaster mitigation in the event of a major hurricane may also be available from FEMA for the type of work needed by the Rockerman Canal. The key here is for the municipality to assume an active position regarding the problems faced by the Canal and its residents and to determine an efficient and effective approach. EDC recommends that the Client apply for the regulatory permits required and if necessary assume the expense since there is a good possibility that permits in hand will facilitate getting local agencies to authorize the work and reimburse the residents in the funding process. 9. Conclusion Based upon the observations detailed in the body of this report, the Rockerman Canal has experienced long term morphological and environmental changes that have reduced tidal exchange, caused erosional bank deposition into the canal, and introduced wetland vegetation that has encroached into the Canal's fairway and significantly reducing navigation ingress and egress for residents to the canal that has affected their quality of life and property values. The Canal's deteriorated condition has been caused by the lack of stabilization of the shoreline and the lack of trimming and maintenance of the vegetation growing uncontrollably on the Kennedy Park bank of the Canal. It is EDC's professional opinion that environmental restoration of the Rockerman Canal is warranted as soon as possible so permanent damage to the Canal's navigability and ecosystem can be avoided and further damage to the property values and quality of life of residents and property owners living on the Rockerman Canal can be avoided. Restoration can be reasonably achieved by (1) removing the sediment accumulated in the Canal; (2) removing and relocating the vegetation that has encroached into the Canal right of way; (3) arresting accretion of the bank of the Canal by stabilizing the shoreline; (4) arresting uncontrolled growth of exotic non-native species and mangrove vegetation curtailing future uncontrolled growth. Regular landscape maintenance of vegetation growing within close proximity to the Canal bank should also be performed; (5) arresting storm water run-off carrying sediment into the Canal by the installation of rip rap and by making a berm to prevent further silting of the Canal. Restoration measures will greatly improve water quality in the Canal. Improved water quality will lure back fish and wildlife to the Canal restoring the ecological health of the Canal. Vessels will be able to navigate the full length of the Canal safely and free of hazards. Navigability and ecological health will restore the property values of the residential side of the Canal. The stabilization of the Park bank of the Canal will prevent future encroachment into the Canal right of way protecting further deterioration from occurring in the future. Public funding sources should be sought through the municipality to cover part of the cost of dredging and shoreline stabilization.
