HomeMy WebLinkAboutLegislation 10-8-09Cit of Miami City Hall ��•--�--��.= Y 3500 Pan American Drive G` ... wn 'r' LegislationMiami, FL 33133 yea; www.miamigov.com Resolution File Number: 09-01039 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MAINTENANCE MEMORANDUM OF AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION, FOR THE MAINTENANCE OF STATE ROAD 933/NORTHWEST 12TH AVENUE FROM NORTHWEST 7TH STREET TO NORTHWEST 15TH STREET, MIAMI, FLORIDA, AS STATED HEREIN. I WHEREAS, the Florida Department of Transportation ("FDOT") has jurisdiction over State Road 933/Northwest 12th Avenue from Northwest 7th Street to Northwest 15th Street, within the limits of the City of Miami, Florida; and WHEREAS, the FDOT has drafted design plans for beautification improvements on State Road 933/Northwest 12th Avenue from Northwest 7th Street to Northwest 15th Street, Miami, Florida; and WHEREAS, the City has agreed to maintains said improvements under the terms and conditions set forth in the Maintenance Memorandum of Agreement ("Agreement"), in substantially the attached form; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with the FDOT, for the maintenance of State Road 933/Northwest 12th Avenue from Northwest 7th Street to Northwest 15th Street, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU 10?4� CITY ATTORNEY City of Miami Page I of 2 Printed On: 9/29/2009 File Number: 09-01039 Footnotes: {1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
