HomeMy WebLinkAboutLegislationFile Number: 09-01353 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDINGS, PURSUANT TO SECTION 18-85 OF THE PROCUREMENT CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI FOR THE PROVISION OF CUSTODIAL SERVICES AT MIAMI CITY HALL; APPROVING THE AWARD OF SAID SERVICES TO HOPE CENTER, INC., RETROACTIVELY, FOR A PERIOD OF OCTOBER 1, 2009 THROUGH SEPTEMBER 30, 2011, WITH OPTIONS TO RENEW FOR THREE (3) ADDITIONAL ONE (1) YEAR PERIODS, AT AN ANNUAL AMOUNT NOT TO EXCEED $56,155.32; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY ATTACHED FORM, FOR SAID PURPOSE; ALLOCATING FUNDS FROM THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION, PROPERTY MAINTENANCE, OTHER CONTRACTUAL SERVICES, ACCOUNT CODE NO. 05001.242000.534000.0000.00000. WHEREAS, the Office of the City Manager has determined that it is not practicable and advantageous to the City of Miami ("City") to adhere; and, therefore waive competitive sealed bidding methods for the provision of custodial services at Miami City Hall performed by Hope Center, Inc. ("Vista") at a monthly low bid amount of $4,679.6 and the Hope Center responded with a bid amount of $7,287.68; and WHEREAS, in support of this social cause, Vista withdrew its' bid so long as it did not adversely affect the bid award of the remaining facilities that they were the lowest responsive and responsible bidder on; and WHEREAS, after several months of negotiations with the Hope Center, on October 28, 2009, they agreed to match Vista's low bid amount of $4,679.61 monthly; and WHEREAS, this item was to be publicly heard by the City Commission in its second meeting in November, but due to the unavailability of a full commission body (the item requires a 4/5th vote), the item was deferred until the availability of a City Commission with all members present; and WHEREAS, pursuant to Section, 18-85, of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has waived competitive sealed bidding methods via the written finding and reasons supporting his conclusion herein; and WHEREAS, said conclusion must be ratified, confirmed, and approved by the Miami City Commission by a four-fifths (4/5ths) affirmative vote during an advertised public hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written findings, pursuant to Section 18-85 of the City Code, are ratified, approved and confirmed, the requirements for competitive sealed bidding methods as not being practicable or advantageous to the City for the provision of custodial services at Miami City Hall, are waived, and the award of said services to Hope Center, retroactively, for a period of October 1, 2009 through September 30, 2011, with options to renew for three (3) additional one (1) year periods, at an annual amount not to exceed $56,155.32, is approved, with funds allocated from the Department of General Services Administration, Property Maintenance, Other Contractual Services, Account Code No. 05001.242000.534000.0000.00000. Section 3. The City Manager is authorized {1} to execute a Professional Services Agreement, in substantially the attached form, for said purpose. Section 4.
