HomeMy WebLinkAboutR-10-0027Vop City of Miami Legislation < U R �O Resolution: R-10-0027 File Number: 09-00985 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 1/28/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDINGS, PURSUANT TO SECTION 18-85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI FOR THE DISPOSAL OF WASTE COLLECTION SERVICES AND PROCURING SAID SERVICES AT SUN RECYCLING FOR THE DEPARTMENTS OF SOLID WASTE AND PUBLIC WORKS, RESPECTIVELY; ALLOCATING FROM THE VARIOUS SOURCES OF FUNDS OF THE RESPECTIVE DEPARTMENTS, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT TIME OF NEED. WHEREAS, on September 29, 1995 the City of Miami ("City") entered into an Interlocal Agreement with Miami -Dade County ("County") for the use of the County Solid Waste Management System Facilities for disposal of certain solid waste materials collected in and by the City through October 1, 2015; and WHEREAS, the Interlocal Agreement established the fees for Fiscal Year 2008-2009 for the disposal and transfer of materials collected in and by the City at $60.43 per ton for disposal at the Resource Recovery Landfill and an additional $11.90 transfer fee, per ton, totaling $72.33 per ton for disposal, at the Transfer Facilities, as applicable; and WHEREAS, in an effort to enhance operation efficiency and minimize the effects of growing costs associated with solid waste disposal, both the Department of Solid Waste and the Department of Public Works have determined that it is necessary to utilize an alternative disposal location within the City to meet the disposal needs; and WHEREAS, the Department of Solid Waste and Public Works have determined that it is not practicable and advantageous to the City to adhere; and, therefore waive competitive sealed bidding methods to dispose waste at the Sun Recycling facility and have presented their determination to the City Manager; and WHEREAS, the use of Sun Recycling would be limited to the use of the disposal of construction debris, asphalt and municipal solid waste collected with mechanical sweepers; and WHEREAS, Sun Recycling, which is located in the City limits at 2000 North Miami Avenue, Miami, Florida, is within three (3) miles of both City departments , who are located at 1290 Northwest 20 Street, Miami, Florida, allowing for a reduction of travel time, savings on fuel costs, and minimizes operators' regular wages/overtime premium payments and damages to the City equipment/vehicles; and City of Miand Page 1 of 2 File Id. 09-00985 (Version: 1) Printed On: 7/14/2017 File Number: 09-00985 Enactment Number: R-10-0027 WHEREAS, the sweepers are better accommodated at the Sun Recycling facility, wherein the Department of Solid Waste employees' have routinely experienced damages of the undercarriages of their sweepers at the County facilities; and WHEREAS, the disposal costs at the County facilities are $60.43 per ton (or $72.33 per ton at the County Transfer Facilities); and WHEREAS, the disposal fee charged by Sun Recycling ranges from $40.23 per ton for concrete to $62.97 per ton for asphalt; and WHEREAS, the use of the Sun Recycling facility would net both department significant savings of disposal costs for these kinds of materials; and WHEREAS, pursuant to Section, 18-85, of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has waived competitive sealed bidding methods by making the written finding containing the reasons supporting his conclusion herein; and said conclusion is subject to being ratified, confirmed, and approved by the City Commission by a four-fifths (4/5ths) affirmative vote after an advertised public hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Commission is approving and ratifying the City Manager's recommendation and written findings, pursuant to Section 18-85 of the City Code, waiving the requirements for competitive sealed bidding methods as not being practicable or advantageous to the City for the disposal of waste collection services and procuring said services at Sun Recycling for the Departments of Solid Waste and Public Works, respectively, is hereby ratified, confirmed, and approved, with funds allocated from the various sources of funds of the respective departments, subject to the availability of funds and budgetary approval at time of need. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1 } Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of the ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
