ON THE CITY OF MIAMI SPECIAL ELECTION
HELD ON JANUARY 12, 2010

I, Priscilla A. Thompson, City Clerk of the City of Miami, Florida, and as the Canvassing
Board for the City of Miami (hereinafter referred to as "Canvassing Board") do hereby
certify that all necessary legal steps were taken in connection with the conduct of a City
of Miami Special Election held on January 12, 2010, including, though not limited to, the
following Logic and Accuracy Tests:
I. On Wednesday, January 6,2010:
A. Commencing at approximately 10:00 a.m. the Miami -Dade County Supervisor
of Elections representative had the tabulating equipment tested to ascertain
that the equipment will correctly count the precinct and absentee ballots cast
for the candidates and/or issues, to be voted in the Miami Special Election to
be held on January 12, 2010.
B. The Canvassing Board compared the test results with the predetermined totals
for each candidate and pursuant to the requirements established in Section
101.5612, Florida Statutes, observed the performance and results of all
required tests and verified the correctness of the programs and equipment, as
well as any replacement of said materials required by said tests, subject to said
tests.
C. At the completion of the above test, there were delivered to us, in a sealed
container with Seal Number 0051476 the verified Logic and Accuracy reports
and test materials, and steps have been taken to ensure the security of said
materials prior to, during and subsequent to the election, except when said
materials are properly in the possession of the Elections Department staff
appointed to conduct the election.
II. On Wednesday, January 6, 2010 through Monday, January 11, 2010:
A. On Wednesday, January 6, 2010, the Miami -Dade County Supervisor of
Elections set the time to begin the opening of the valid absentee ballots and
the duplication of ballots (as needed) at 10:00 a.m. and commencing at 1 p.m.
on Monday, January 11, 2010, the Canvassing Board resumed opening of the
absentee ballots.
III.On Tuesday, January 12, 2010 (Election Day)
A. At approximately 5:00 p.m., the Miami -Dade County Supervisor of Elections
began the pre -count logic and accuracy test of the optical scan system used for
paper ballots, located at the Elections Department at 2700 NW 87th Ave., to
ascertain that the equipment had not been tampered with, and that it would
correctly count the precinct and absentee ballot votes cast for all City of
Miami candidates.
B. At the completion of the precinct and absentee ballot count, the pre-election
test of the automatic tabulating equipment was again tested at approximately
7:00 p.m., before the official count of ballots to ascertain that the equipment
correctly counted the precinct and absentee votes cast for all City of Miami
candidates.
C. At the completion of the tabulation of election results, approximately 9:45
p.m., the Miami -Dade County Supervisor of Elections presented me with the
certification of elections tabulation. Per Florida Statute 101.048(1) persons
casting provisional ballots have the right to present written evidence
supporting his or her eligibility to vote to the supervisor of elections by not
later than 5 p.m. on the third day following the election. That deadline was
Thursday, January 14, 2010. On Friday, January 15, 2010 we received the
certified official tabulation of election results.
IV. I further certify that all documents concerning the above Logic and Accuracy Tests
showed the tabulating equipment to be functioning correctly and that said documents
are presently in the possession of the Supervisor of Elections of Miami -Dade County,
in containers which were sealed under seal number 0051476 and signed off by the
Supervisor of Elections and the City Clerk.
V. I further certify and declare that the results of the nonpartisan City of Miami Special
Election which was held on January 12, 2010, are as follows:

VI. I further certify and declare that:
• in the race for Commission District 1,
Wifredo
(Willy) Gort
received the
greatest number of all votes cast and is hereby declared to have been elected City
of Miami District 1 Commissioner; and
• in the race for Commission District 5,
Michelle
Spence -Jones
received the
greatest number of all votes cast and is hereby declared to have been elected City
of Miami District 5 Commissioner.

VII. On Friday, January 15, 2010 (Post Election Audit)
A. At approximately 10:00 a.m. the Miami -Dade County Supervisor of Elections
conducted a post election manual audit at the Elections Department at 2700
NW 87th Ave. according to Florida Division of Election Rule 1 S-5.026. The
audit entailed audit teams manually counting the ballots cast by absentee
voting, and by Election Day voting, for a randomly selected precinct within a
randomly selected race. At the completion of the audit on Friday, January 15,
2010, at approximately 11:45 a.m. we received the voting system post election
audit report.
