HomeMy WebLinkAboutR-10-0010Vop City of Miami Legislation < U R �O Resolution: R-10-0010 File Number: 09-01446 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 1/14/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AFTER A DULY NOTICED PUBLIC HEARING, APPROVING AN AMENDMENT TO THE ORIGINAL SCOPE OF WORK FOR THE AFRICAN SQUARE PARK PROJECT (THE "ORIGINAL PROJECT"), AS ADOPTED ON JULY 16, 1996, BY THE MIAMI-DADE COUNTY SAFE NEIGHBORHOOD PARKS BOND ORDINANCE NO. 96-115, THEREBY DELETING RENOVATIONS TO THE AMPHITHEATRE, AND IMPROVEMENTS TO THE PLAYING FIELD, AND INSTEAD, PROVIDING FOR THE ADDITION OF NEW LINOLEUM FLOORING TO THE AFRICAN SQUARE PARK RECREATION CENTER, PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF A NEW PLAYGROUND AND A NEW TOT LOT, AND PROVIDING FOR THE INSTALLATION OF SITE FURNISHINGS THROUGHOUT THE PARK (THE "AMENDED PROJECT"); AUTHORIZING AND DIRECTING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT REVISED GRANT APPLICATION TO MIAMI-DADE COUNTY FOR SAID CHANGES IN THE ORIGINAL PROJECT, TO EXECUTE ANY RELATED GRANT AMENDMENT, AND TO ACCEPT ANY REVISED RELATED GRANT FUNDING RECEIVED FROM MIAMI-DADE COUNTY FOR THE AMENDED PROJECT; DIRECTING THE CITY MANAGER TO OPERATE AND TO MAINTAIN SAID AMENDED PROJECT UPON ITS COMPLETION. WHEREAS, in 1996 the citizens of Miami -Dade County ("County") authorized the issuance of General Obligation Bonds (Safe Neighborhood Parks Bonds) for the purpose of financing capital improvements for certain parks, beaches, natural areas and recreational facilities; and WHEREAS, the Safe Neighborhood Parks Bond ("SNPB") Program was officially adopted on July 16, 1996, pursuant to County Ordinance No. 96-115, listing all projects and their respective scope of work; and WHEREAS, the original scope of the African Square Park Project (the "Original Project") includes renovation and improvements to the amphitheater, the playing field and the addition of a new tot lot; and WHEREAS, it is most advantageous to utilize the SNPB dollars toward new linoleum flooring in the recreation building, the construction of a new playground, a new tot lot, and site furnishings throughout the park; and WHEREAS, the County's SNPB Oversight Board approved the proposed scope of work changes to the Original Project at its December 16, 2009 meeting; and WHEREAS, reimbursement from the County for costs associated with said renovations which constitute a change in the scope of work for the Original Project to be amended (the "Amended City of Miand Page 1 of 2 File Id. 09-01446 (Version: 1) Printed On: 7/13/2017 File Number: 09-01446 Enactment Number: R-10-0010 Project"), requires a duly noticed public hearing and City Commission approval; and WHEREAS, a public hearing notice for the Amended Project to be considered at the City Commission's January 14, 2010 meeting was published in the Daily Business Review on January 4, 2010; and WHEREAS, the proposed changes in the Original Project and related changes in reimbursement for costs require the City to submit a revised grant application for review and approval by the County for the Amended Project and for County Commission approval. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An amendment to the original scope of work for the Original Project, as adopted on July 16, 1996, by the County SNPB Ordinance No. 96-115, is approved, thereby deleting renovations to the amphitheatre, and improvements to the playing field, and instead, providing for the addition of new linoleum flooring to the African Square Park recreation center, and providing for the construction and installation of a new playground and a new tot lot, and providing for the installation of site furnishings throughout the park, as the Amended Project. Section 3. The City Manager or his designee are authorized{1} and directed to submit a revised grant application to the County for said changes in the Original Project, to execute any related Grant Amendment, and to accept any revised related grant funding received from the County for the Amended Project. Section 4. The City Manager is directed to operate and to maintain said Amended Project upon its completion. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
